Updated Land Clearing and Inert Debris Landfill Notification recorded with the Alamance County Register of Deeds July 13, 2017 Status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is compliant with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS: Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 The facility is in violation of 15A NCAC 13B .0566(4) in that Mr. Morrow stated that land clearing debris (LCD) along the right front side slope and rear side slope have been uncovered for more than a month. The facility is actively receiving LCD. Mr. Morrow stated that he was planning to place more material along the rear side slope and cover it with soil and that he was unaware that he needed to apply additional soil to adequately cover LCD along the right front side slope. The facility has complied with the aforementioned soil cover requirement in that it has covered all material > 30 days/1 month since receipt. The land clearing and inert debris (LCID) landfill was receiving material during the inspection. Mr. Morrow stated that all uncovered material at the landfill has been recently received (< 30 days/1 month). The Observed Violation of 15A NCAC 13B .0566(4) has been resolved. OBSERVED VIOLATIONS: None. ADDITIONAL COMMENTS On September 8, 2017, John Patrone met with Patrick Morrow to conduct a comprehensive inspection of the J.L. Morrow, Jr. Construction Landfill – LCID Landfill on Mebane Oaks Road in Mebane, Alamance County. 1. The J.L. Morrow, Jr. Construction Landfill – Land Clearing and Inert Debris (LCID) Landfill is located behind the residence, via gravel road, at 4423 Mebane Oaks Road. 2. The LCID landfill is designated as 1.99 acres on a separate parcel located on the property. 3. During the inspection, land clearing debris (LCD) was being off-loaded on site. 4. Mr. Morrow stated that all the LCD on site has been received within the last month and that it will be placed accordingly, adequately covered with soil, and graded. 5. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 6. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 7. Mr. Patrone informed Mr. Morrow that when LCD/LCID is adequately covered with soil it shall not be visible. 8. Side slopes should be graded and covered with soil such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 9. Mr. Morrow stated that soil is stockpiled on the property for use as cover material. 10. No indication of erosion or runoff was observed. 11. J.L. Morrow, Jr. Construction Landfill – LCID Landfill is also a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS01-009. 12. Access roads are of all-weather construction. 13. The site is secured by a steel cable with lock. 14. The facility has proper signage. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
