STATUS OF PAST NOTED VIOLATIONS:
1. 15A NCAC 13B .1626 (8)(e); Resolved
The area where the leachate release occurred has been repaired. Photos are included at the end of this
inspection report.
2. 15A NCAC 13B .1626 (2)(a); Unresolved
Cover material requirements.
Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover
disposed solid waste with six inches of earthen material at the end of each operating day, or at more
frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging.

3. 15A NCAC 13B .1626 (2)(c); Unresolved
Areas which will not have additional wastes placed on them for 12 months or more, but where final
termination of disposal operations has not occurred, shall be covered with a minimum of one foot of
intermediate cover.
4. 15A NCAC 13B .1626 (7)(c); Unresolved
Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30
working days or 120 calendar days upon completion of any phase of MSWLF development.
Waste was observed exposed across all side slopes of the Active MSW landfill at the time of this
inspection.
OBSERVED VIOLATIONS: See above.
ADDITIONAL COMMENTS
1. Waste was observed protruding from all side slopes of the Active MSW landfill. In accordance with 15A
NCAC 13B .1626 (2) corrective actions are required. All waste must be covered each day in accordance
to the permit, rules and approved operations plan for this facility.
2. Bare and eroded areas were observed during this inspection. Bare areas need to be seeded and mulched to aid in
erosion prevention as soon as they are observed.
3. Adequate sediment control measures (structures or devices), shall be utilized to prevent onsite erosion and silt
from leaving the landfill. Provisions for a vegetative ground cover sufficient to restrain erosion must be
accomplished within 30 working days or 120 calendar days upon completion of any phase of MSWLF
development.
4. Fencing has been added to the top of the MSWLF to mitigate windblown materials. Continue to do a good
job of cleaning up windblown waste.
5. The slopes of the landfills are to be maintained at a minimum of 4:1, except for the eastern slope, of the
active MSW phase III, which may be graded at a 3.5:1 slope as approved in the Approval of Phase III
Operating Capacity Modification letter dated August 8, 2016. Any modifications or changes to the
approved operations plan or permit must be submitted to the permitting branch for approval prior to
implementation.
6. It is strongly recommended that facility staff not drive heavy equipment and trucks up side slopes, to prevent
slope destabilization and erosion, once intermediate cover has been placed.
7. Per facility operations plan, the permittee must properly maintain permanent physical markers that accurately
identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill
facility.
8. Unacceptable waste such as tile, mastic and painted materials such as concrete and brick must be removed
from the inert debris pile. The materials may be disposed properly in the CDLF. Grinding or crushing of
this waste could cause the release of asbestos, lead or other hazardous materials into the air and surface
water. The comingling of these waste can contaminate the recycled concrete and require the comingled
crushed waste to be disposed of in the CDLF.
9. The leachate release noted as a violation in the February 21, 2017 inspection report has been repaired and the
violation resolved. To prevent this type of release from occurring again the County worked with their engineering
consultant to excavate, install an additional sump to pump leachate directly into the collection system, and then
back fill the area.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

10. The area where mulch in the tree line adjacent to the eastern slope of the landfill needs to be drain of all
water. Water should be disposed in the leachate collection system. A plan needs to be established and
submitted to the Solid Waste Section addressing the regrading of this area and future use. Please update
your site foot print to include the mulch storage area.
11. Gas collection manhole on Closed MSW was drained and cones placed around the opening. Good.
12. Improvements have been made since the last inspection on 3/2/2017. Corrective measures are necessary
based on the landfill conditions observed during this inspection and should be completed by July 31, 2017
to bring the site into compliance with the rules, permit and approved operations plan.
