Permit number SLAS-79-06/Conditions of Operating Permit Section two states in part: This site shall be operated and maintained in accordance with the nutrient management plan (NMP)submitted by Patrick and Eric Gann and approved by the Division of Waste Management. Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0838 (a)(7) because the approved Nutrient Management Plan (NMP) Section B paragraph 2 states in part: “In order for this fescue field to receive septage, a 80% stand should be maintained”. Field 2 appeared to have less than 80% coverage of fescue. The other vegetation was either dormant, dead or damaged at the time of inspection. In order to come into compliance, Gann Brothers Septic Tank Service, Inc. must either follow the current NMP FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 for SLAS-79-04 or change the Plan to reflect other crops. You can also contact the Rockingham County Cooperative Extension at 336-342-8230 for advice on field maintenance and weed control. If another crop other than fescue be desired or recommended, a revised Plan, written by a certified technical specialist, reflecting the change must be submitted. Contact Connie Wylie at connie.wylie@ncdenr.gov or 910-433-3352 to update the Plan. This violation is not yet resolved. The NMP is to be updated with the next permit renewal/revision. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. The Septage Land Application Site consists of Field 1 (5.8 acres) and Field 2 (5.6 acres). 2. The site is permitted for land application of domestic septage and grease septage. 3. The site is located at 367 Case Road and has accessible all-weather roads to the septage land application field covered under the permit. 4. Appropriate signage was displayed at the site. 5. Disposal area boundaries were delineated with permanent markers. 6. All septage discharges appear to have been made within the disposal area boundary. 7. There is no evidence of standing liquid or pooled waste. The waste appeared to be evenly distributed throughout the fields. 8. The nutrient management plan is to be revised to reflect the current crop. 9. No objectionable odors were observed. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
