Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Septage Detention and Treatment facility (SDTF) consisted of one above ground 12,000-gallon carbon steel tank for the storage of domestic septage and grease trap pumpings. 2. Set-back/buffer requirements appear to have been met. 3. Appropriate signage was displayed at the site. In addition, the tank is located behind a chain link fence. 4. The access road to the tank was well maintained. 5. The tank appeared to be structurally sound and well maintained. 6. The area around the detention and treatment area was found to be free of spills and debris. The area around the tank was free of vegetation; however, non-vegetative materials were located next to the tank. State regulations require the area around the tank to be free of debris a distance of 5 feet. 7. No odors observed around the tank.
