On February 15, 2017, LES was observed to be in violation of North Carolina Solid Waste Permit SDTF-34-06, Operating Permit Condition #3 states: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g) A Notice of Violation (NOV) was issued to LES on February 16, 2017. A response to the NOV was received by the Solid Waste Section on February 20, 2017 describing actions to be taken for odor control. The installation of an additional 8,000 scfm scrubber was to be completed by the end of May 2017 with the Odor and Vector Control Plan to be updated accordingly; however, the company is still working out maintenance issues the scrubber system. The violation is not yet resolved. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. On Thursday, July 27, 2017, The Solid Waste Section received a complaint via e-mail at 11:44 AM, concerning the continuation of odors from the Liquid Environmental Solutions of Georgia, LLC (LES). 2. An investigation was conducted that same day from 3:40 PM until 4:04 PM, at the perming lot of the Teddy Soft Paper Products. A slight odor was detected upon arrival but only lasted a few seconds. The winds were variable. A stronger odor was observed at the entrance to the facility but again only lasted for a few seconds. According to staff at the facility, odors had been detected earlier that day. The scrubber is to be taken apart for cleaning that evening. 3. This septage treatment facility consists of one 10,000-gallon tank, one 10,000 raw material bin and three 25,000 gallon tanks for a total storage capacity of 95,000 gallons for the storage of untreated and treated septage. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
