Permit Condition 2 -This site shall be operated and maintained in accordance with the nutrient management plan submitted by David Mecimore and approved by the Division. Permit Condition 7 -Monthly septage applications shall not exceed the monthly relative application rates given in the approved nutrient management plan for the site. 15A NCAC 13B .0832(a)(6) -All conditions for permits issued in accordance with this Section shall be followed. Upon review of the land application site logs submitted for the permit renewal it was noted that the monthly application rates have been exceeded every summer since 2011. The months of June, July and August have a “low” application rate of 5,000 gallons as per the approved nutrient management plan. The site is permitted for 4.1 acres which multiplied by the 5,000 gallons allows only 20,500 gallons as a maximum for each of those months. Based on the information given in the submitted logs the rates were exceeded as followed. SEE BACK OF PAGE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 June 2011 – 57,000 gallons discharged/exceeded by 36,500 gallons July 2012 – 53,000 gallons discharged/exceeded by 32,500 gallons August 2012 – 24,500 gallons discharged/exceeded by 4,000 gallons July 2013 – 23,000 gallons discharged/exceeded by 2,500 gallons August 2013 – 47,000 gallons discharged/exceeded by 26,500 gallons August 2014 – 47,000 gallons discharged/exceeded by 26,500 gallons June 2015 – 53,500 gallons discharged/exceeded by 33,000 gallons June 2016 – 74,750 gallons discharged/exceeded by 54,250 gallons June 2017 – 36,100 gallons discharged/exceeded by 15,600 gallons July 2017 – 31,700 gallons discharged/exceeded by 11,200 gallons This is a violation of the NC Septage Management Rules & Permit Conditions. This violation was also previously noted during the permit review of the site logs in 2011 (audit report 4/20/2011) where the monthly rates were exceeded on three separate occasions. Discharge events shall be monitored by the operator (throughout the month) to ensure that monthly application rates shall not be exceeded, particularly during the “low” months as per the approved nutrient management plan. Failure to follow the Septage Management Rules & Permit Conditions may result in additional enforcement action. It was also noted during the review of the submitted logs that the required time of discharge and ph of each discharge were not recorded from 2012 – July 2017 as per Rule .0838(e)(1). Begin recording this required information for each discharge event. I have enclosed an example log for your use. It was also noted that the maximum annual application rate of 205,000 gallons was not exceeded during this time frame. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
