UPDATE
An approval to operate by the Section is required prior to commencement of operations at the referenced transfer facility. The
following requirements shall be met prior to issuance of an approval to operate:
a. A revised Operations Plan for the new facility shall be submitted. Complete 7/10/2017
b. A site inspection shall be made by a representative of the Section. Complete 6/1/2017
c. Construction must be completed in accordance with the approved plan. A certification letter stating that the facility and
related infrastructure was constructed in accordance with the approved plan shall be submitted to the Section by the
Project Engineer who shall be a North Carolina registered professional engineer. See below, to be provided by
September 1, 2017.
d. Three (3) copies of the construction record (As-built) drawings shall be submitted to the Section for filing and records.
An electronic copy (pdf) is all that is now required. See below, to be provided by September 1, 2017.
e. Updated compliance history review and organization chart shall be submitted. Submitted 7/12/2017.
f. Updated and approved financial assurance cost estimates shall be submitted. Submitted 5/2/2017.
g. Updated and approved financial assurance mechanism shall be submitted. Submit for Section (Sarah Rice)
approval.
4. A representative of the Section shall notify the Permitting Branch Supervisor in writing, either by letter or e-mail, that the
conditions have been met. The owner and operator shall be copied on the correspondence. The notification shall suffice as
permission to operate as of the date of the notification. Once I have the remaining pieces of information, I will issue an
approval to operate.

Pursuant to our conversation yesterday concerning the startup of our sorting equipment, please accept
this notification as a request to proceed. As I explained yesterday, Machinex, the equipment
manufacturer, has an available start up for us on July 24th to check, fine tune and train on the sorting
machine. If we don’t meet that deadline, we would have to delay start up until October. With that said,
we are requesting permission to inject materials into the sorting machine on July 24th.
The building construction is not complete and will not be fully completed for approximately 4 weeks. At
that time, we will be able to complete the amended permit application with the submittal of the “as
built” drawings and the certified letter from our engineer that the construction conforms to the
plans. For the purpose of injecting material into the system, all environmental and operational systems
are constructed and fully functional. In addition to those requirements, we have also applied for the
increased dollar amount on our financial assurance and that will be forth coming. Until that instrument
is in place, we will not exceed the volume that the current financial assurance provides for.
