!SA NCAC 2L .0202 and/ or soil contamination exceeds the lower of the soil-to-groundwater or
residential MSCCs, public notice in accordance with !SA NCAC 2L .0409(b) also is required. Thus,

NOTICE OF RESIDUAL PETROLEUM

The prope1ty that is the subject of this Notice (hereinafter referred to as the
"Site") contains residual petroleum and is an Underground Storage Tank (UST) incident under
North Carolina's Statutes and Regulations, which consist ofN.C.G.S. 143-215.94 and regulations
adopted thereunder. This Notice is part of a remedial action for the Site that has been approved by
the Secretary (or his/her delegate) of the North Carolina Department of Environment and Natural
Resources (or its successor in function), as authorized by N.C.G.S. Section 1438-279.9 and
1438-279.11. The North Carolina Depmtment of Envirmnnent and Natural Resources shall
hereinafter be referred to as "DENR".
NOTICE
Petroleum product was released and/or discharged at the Site. Petroleum
constituents remain on the site, but are not a danger to public health and the environment,
provided that the restriction described herein, and any other measures required by DENR
pursuant to N.C.G.S Sections 143B-279.9 and 143B-279.11, are strictly complied with. This
"Notice of Residual Petroleum" is composed of a description of the property, the location of the
residual petroleum and the land use restrictions on the Site. This Notice has been approved and
notarized by DENR pursuant to N.C.G.S. Sections 143b-279.9 and 1438-279.11 and has/shall be
recorded at the Durham County Register of Deeds' office in Book , Page __ _
Source Property
GWC Prope1ties of Durham, North Carolina is the owner in fee simple of all or a portion of the
Site, which is located in the County of Durham, State ofNmth Carolina, and is known and legally
described as:
BEGINNING at a stake at the point of intersection of the inside of the sidewalk on the
west side of Walker Street with the inside of the sidewalk on the south side of Elizabeth Street in
the City of Durham and running thence along and with the inside of the sidewalk on the west side
of Walker Street, South 14 deg. 30 min. East 161.4 feet to a stake, northeast corner of property of
Marcus G. Carpenter; running thence along and with the nmthern line of Marcus G. Carpenter
and Marion C. Brackett. South 69 deg. 3 min. West 153.23 feet to a stake in the line of
Carpenter's, Inc.; running thence Nmth 15 deg. West 57 feet to a stake. Southwest corner of
Property of Lena Carpenter; running thence along and with the southern line of property of Lena
Carpenter North 69 deg. 25 min. East 94.3 feet to a stake; running thence North 14 deg. 30 min.
West 109.5 feet to a stake at the inside of the sidewalk on the south side of Elizabeth Street North
73 deg. 30 min. East 60 feet to a stake, place and point of BEGINNING, and being Lot #3 as
shown on plat and survey entitled "Property of J. E. Carpenter Estate and Vallie M. Carpenter",
dated October 19, 1962 by J. Watts Copley, Land Surveyor, recorded in the office of the Register
of Deeds, of Durham County in Plat Book 46 at page 29.
For protection of public health and the environment, GWC Properties, acting by
and through Marcus G. Carpenter, hereby declares that all of the real property described above
shall be held, sold and conveyed subject to the following perpetual land use restrictions, which
shall run with the land; shall be binding on all parties having any right, title or interest in the
above described property or any part thereof, their heirs, successors and assigns; and shall, as
provided in N.C.G.S. Section 143B-279.9, be enforceable without regard to lack of privity of
estate or contract, lack of benefit to particular land, or lack of any property interest in particular
land. These restrictions shall continue in perpetuity and cannot be amended or cancelled unless
and until the Durham County Register of Deeds receives and records the written concurrence of
the Secretaiy (or his/her delegate) ofDENR (or its successor in function).
PERPETUAL LAND USE RESTRICTIONS
Groundwater: Groundwaterfiwn the site is prohibited from use as a water
supply. Water supply wells of any kind shall not be installed or operated on the site.
ENFORCEMENT
The above land use restriction shall be enforced by any owner, operator or other
party responsible for the Site. The above land use restriction may also be enforced by DENR
through the remedies provided in N.C.G.S. Chapter l 43B, Article 7, Patt 1 or by means of a civil
action, and may also be enforced by any unit of local government having jurisdiction over any
pmt of the Site. Any attempt to cancel this Notice without the approval ofDENR (or its successor
· in function) shall be subject to enforcement by DENR to the full extent of the law. Failure by any
party required or authorized to enforce the above restriction shall in no event be deemed a waiver
of the right to do so thereafter as to the same violation or as to one occurring prior to or
subsequent thereto.

Immediately following the sample collection in a re-sealable plastic baggie, the sample was collected
in laboratory supplied/preserved containers and placed within an ice chilled cooler for transportation
to the analytical laboratory.
The soil sample identified as WO-UST-2 was collected from approximately 6 feet BGS and was
submitted to Environmental Conservation Laboratories (ENCO), a North Carolina certified
laboratory located in Cary, NC for analyses by EPA Method 8260, EPAMethod 8270, Massachusetts
Department of Environmental Protection (MADEP) Volatile Petroleum Hydrocarbons (VPH),
MADEP Extractable Petroleum Hydrocarbons (EPH), Chromium, and Lead.
Observations made during the excavation of the former waste oil UST-2 basin showed soils consisting
of brown sandy clays to the excavation termination depth of 9 feet BGS. Photodocumentation
showing the excavated basin and ponded water at approximately 9 feet BGS has been included in
Attachment B.
Review of the soil analytical results summary included as Table 2 shows that none of the target
compounds detected above laboratory method detection limits were reported to be in excess of the
Soil to Groundwater Maximum Soil Contaminant Concentrations (MSCCs) when analyzed by EPA
Method 8260 and 8270, MADEP VPH and EPH, Chromium, and Lead. Complete laboratory
analytical reports with chain-of-custody documentation have been included in Attachment C.
Based on the analytical results obtained from the laboratory analysis of soil sample WO-UST-2, it
appears that no further soil assessment or remediation will be required to address the waste oil UST-2
basin soils.

Receipt of the MADEP VPH and EPH, and Cr by 3030c extraction analytical laboratory results for
MW-I through MW-SD indicated that no concentrations of any detected compounds were in excess
of the NCAC 2L groundwater standards. Complete laboratory analytical reports with chain-of-
custody documentation and a summary of the April 27, 2005 sampling results have been included as
Attachment A and Attachment B respectively. Attachment C includes Figure I and Figure 2, or the
site vicinity topographical location map and a site plan map showing the locations of the monitoring
wells.
Based on the above described results it appears that conclusions made in the April 26, 2005 dated
LSA Phase I and Il Report have not been affected. If you have any questions or concerns regarding

This letter is being provided to inform you that the State of North Carolina Department of
Environment and Natural Resources (NCDENR) -Division of Waste Management (DWM) has
determined that No Further Action is required for an environmental cleanup of a discharge or release
from a petroleum underground storage tank system located in your area. Because the property is
located within Durham County and properties contiguous to the impacted area or contiguous to an
area where contamination is · expected to migrate, the State rules governing groundwater
classifications and standards (I SA NCAC 2L .0 I IS), require that you be informed of this notification
