The Septage Detention and Treatment facility (SDTF) consisted of one 2,300 gallon above ground steel tank. 2. All photographs were taken by Troy Harrison on January 8, 2016. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The nearest house was measured using a laser range- finder to be 90.5 yards (271.5 feet). The distance to the nearest property line was determined to be approximately 85.9 feet using the Burke County GIS. The distance to the surface water was determined to be approximately 335.9 feet using the Burke County GIS. 4. Appropriate signage (No Trespassing signs) is posted for the site. In addition, the area is also protected by a fence around the property and a security system. 5. All weather roads are maintained for access to the site. 6. The tanks appeared to be structurally sound. The area around the tank was free of Vegetation. 7. The tank does not appear to have been used. 8. The coordinates submitted with the application were incorrect. GPS measurements were taken during the inspection and reflect the location of the tank and are reflected in this document. 9. The permit application contained the “Landowner’s Authorization to Operate a Septage Detention or Treatment Facility” (Landowner’s Authorization) signed by Mr. Newton. The Burke County Register of Deeds office also list Debbie Newton as the owner. A new Landowner’s Authorization will need to be submitted with both owners’ names in the form.
