STATUS OF PAST NOTED VIOLATIONS:
.0841(j) The spill areas at tanks #2, #3 and #6, plus at the truck unloading/grease box area have been cleaned up.
Review procedures and implement changes to prevent leaks & spills of septage at this facility. Routine monitoring
should be performed at the end of each business day & any needed clean up done at that time.
The contaminated liquid/scum layer have been removed from the dug pond at the back of the site. Mr. Mayberry stated
that the pond would be regularly cleaned. LES is going to pursue the construction of an adequate storm water retention
pond on site.

ADDITIONAL COMMENTS
1. The “No Trespassing” sign has been reposted. The access road is adequate.
2. The above ground tanks appear structurally sound.
3. The approved setbacks are being met.
4. It appears that septage is being transferred to/from the facility in a safe and sanitary manner. No vectors or
odors noted.
5. The required 5’ cleared radius is present around the tanks at this time.
6. The permit review process is continuing in regards to site drawings, operation manual, treatment logs etc.

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
