Dear Mr. Toepfer,
On July 6, 2017 the Division of Waste Management, Solid Waste Section (Section) performed
the required pre-operation meeting for Cell 3 of Duke Energy’s Sutton Energy Complex
industrial landfill Permit No. 6512-INDUS-2016 (Facility).
The Section has reviewed all documentation submitted on behalf of Duke Energy and hereby
issues Duke Energy a permit approval to operate for Cell 3 at the Facility. Duke Energy may
commence landfill operations in the approved Cell 3.

Please note, Duke Energy must submit construction quality assurance documentation for all
future construction and receive approval from the Section prior to placing future landfill cells
into operation.
