Based on the documents, NVR, Inc. is proposing purchasing the property and developing a townhome community on a portion of the Arrow Laundry & Cleaners Brownfields Property. On March 19, 2007, Lake City Tractor Supply, LLC filed for recordation at the Mecklenburg County Register of Deeds Office,a Notice of Brownfields Property (Notice)The Notice was recorded in Book 21931, Pages 172-204(with the associated plat recorded in Plat Book 47, Page 803). Then,on October 20, 2014, an amendment to the Notice was filed for this brownfields property, recorded in Book 29517, Page 56. In your summary letter,you request DEQ comment and/or approval for Land Use Restriction (LUR) Numbers 3, 5, 6 and 8 in the Notice. •LUR 3 and 8 were canceled in the amendment filed in October 2014. Therefore, no additional comments are necessary. •LUR 5 addresses groundwater and potential activities that would encounter, expose or use groundwater. The Groundwater Assessment Report dated February 19, 2016 includes sampling data from temporary monitoring wells. The results indicated no compounds were detected above the NCAC 15A 2 L Groundwater Standards. Based on the results, DEQ will not require additional assessment. This LUR has been satisfied. •LUR 6 address potential for vapor intrusion for building within 100 feet of the volatile contaminant plume. Based on the current sampling data, the proposed buildings in the summary letter are not within this boundary. DEQ will not require additional assessment. This LUR has been satisfied for this development plan.
