(marykatherinestukes@parkerpoe.com); Ron Mahle (rmahle@monroenc.org); Edwards, Caroline Subject:DEQ Internal Brownfields Notification <21015 Five Points Gateway Monroe, Union County> Date:Monday, March 27, 2017 8:40:50 AM Attachments:09231233 GIS Aerial.jpg09231234 GIS Aerial.jpgimage003.png   To DEQ Cleanup Programs: This is an internal courtesy notice to inform your program that the DEQ Brownfields Program has received a Brownfields Property Application submitted by the City of Monroe as the Prospective Developer (PD) seeking entry into the Brownfields Program for the following property:   Site Name: Five Points Gateway Address:  320 and 322 East Franklin Street City/County/Zip:  Monroe, Union County 28111 BF Project Number: 21015-17-090 Tax ID:  09231233; 09231234  Known Identifying: None found NCD#:  None found GW Incident #: None found Map links: https://goo.gl/maps/1Dfb28kcouF2   320 E Franklin St  https://goo.gl/maps/AtYB8sV97JE2   322 E Franklin St We are now evaluating the City of Monroe and the subject property for eligibility for entry into the Brownfields Program.  The potential Brownfields Property consists of two parcels totaling 1.8 acres.  The 320 Franklin Street parcel was previously utilized as residences (at least 1908-1930s), gas station/auto repair facility (1947-1959), and commercial property since 1959. The 322 Franklin Street parcel was previously utilized as residences (at least 1908-1960s) and a commercial building since 1964. The two commercial buildings located on the potential Brownfields Property were constructed in 1947 and 1964. The potential Brownfields Property is currently occupied with vacant (since December 2016) commercial buildings and a parking lot. There is known chlorinated solvent, petroleum, and metal contamination in soil and groundwater. The PD plans to redevelop the potential Brownfields Property for civic/governmental use with potentially accompanying commercial, retail, office, and open space uses. A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or enforce against any and all parties who caused or contributed to the contamination at the property. In fact, the BFA will require the developer to provide access to the property to any party doing work under any DEQ program. A BFA provides liability protection only to a non-causative redeveloper of the property. The developer will be required to make the property safe for its intended re-use. Cleanup to unrestricted use standards will not be required unless deemed necessary based on the developer's proposed use of the property. Furthermore, the BFA will not change the developer's responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.) as required under applicable law.
