This agreement was recorded in November 2014 and is currently being redeveloped. As a reminder, the agreement is between DENR and the prospective developer of the property and does not relieve any party responsible for contamination at the site from liability. Therefore DENR cleanup programs are free to pursue any and all parties who caused or contributed to the existing contamination at the site. Furthermore, the brownfields agreement will not change the prospective developer's responsibility to obtain any and all DENR permits (e.g. stormwater, sediment control, NPDES, etc.) required for its operations or activities on site from the appropriate DENR agencies, as required under applicable law. Under the brownfields agreement, the Prospective Developer has committed itself to redevelopment for industrial, office, parking, retail, and, if DENR issues prior written approval, other commercial purposes, and transportation, including CATS LYNX BLE project. The current BLE project plan includes two light rail passenger stations, a light rail car storage yard, and an operations and maintenance facility with office space.  A Notice of Brownfields Property along with a plat showing residual contamination, has been recorded at the Mecklenburg County Register of Deeds’ office by the prospective developer, in the form of a “Notice of Brownfields Property."
