OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0841 (i) states: “The area around tanks shall be free of debris and vegetation to allow for access
and inspection for a distance of at least 5 feet.”
B & M Septic Tank. Inc. was in violation of 15A NCAC 13B .0841 (i) because vegetation was observed
uncontrolled around the tanks.
In order to come into compliance, B & M Septic Tank. Inc. must cut back the vegetation at least within 5 feet
away from the tanks by July 14, 2016.

ADDITIONAL COMMENTS
1. All photographs were taken by Troy Harrison on June 21, 2017.
2. The Septage Detention and Treatment facility (SDTF) consisted of one 10,000 gallon steel tank, one 6,000
gallon steel tank and one 12,000 gallon fiberglass tank. These tanks are above ground and shall be used for the
storage of domestic septage (including portable toilet waste) and grease trap septage. The permit also lists two
10,000 steel tanks to be placed at this location in the future. These additional tanks shall not be used until they
are placed in position, inspected by the Solid Waste Section and found to be in compliance.
3. Set-back/buffer requirements appear to have been met.
4. Appropriate signage was displayed at the entrance to the site.
5. The entrance road was accessible.
6. The tanks appeared to be structurally sound and well maintained.
7. The area around the detention and treatment area was found to be free of spills and debris.
8. Vegetation was observed growing around the tanks.
9. No odors observed in the area of the detention and treatment area.

enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
