Dear Ms. Hardin:
On June 28, 2017, the Division of Waste Management, Solid Waste Section (Section) received
Duke Energy’s request entitled;
Industrial Landfill No. 1 Cells 3 and 4 Leachate System Modifications Request, Permit No.:
1812-INDUS, Marshall Steam Station, Catawba County, Terrell, North Carolina 28682.

The request concerns modification to the leachate removal system for Cells 3 and 4 of the
industrial landfill, Permit No. 1812-INDUS-2008. The submitted drawings include temporary
discharge piping to the currently permitted ash basin and future piping to a yet to be designed
retention basin. The Section has reviewed the proposed revisions and sees nothing in the
drawings or the concept that it would not approve. However, the Section cannot approve the
revisions at this time because none of the proposed revisions are stamped by a licensed
professional engineer (PE). The Section therefore requests Duke Energy resubmit the
information and supporting calculations with the proper PE review, for approval.
Note, as Duke Energy moves toward the storage of leachate for processing in permitted
wastewater treatment plants and away from permitted ash basin treatment, as recently presented
at Allen and Marshall, the Section must be consulted in the design of all proposed leachate
storage/retention basins (basins that store leachate) with regards to; siting, construction, storage
capacity, and proper permitting.
