Box 12339 Winston-Salem, NC 27117 SUBJECT: Abbey Green, Inc. and Overdale Holdings, Inc. Transfer, Recycle, Resource Recovery and Processing Facility Permit No. 3424-TRANSFER-2010 Forsyth County Dear Mr. Baker: The Solid Waste Section issued a Notice of Violation letter for this facility on March 21, 2017. Since that time, we have met onsite on April 4, 2017, you have provided six letters of response (March 23, March 28, April 3, April 21 (2 letters) and June 23, 2017). We also met, at your request, at the Winston-Salem Regional Office on April 19, 2017 to discuss all of the issues outlined in the original Notice of Violation that remain unresolved. During that meeting, we agreed to certain specific corrective actions that Abbey Green, Inc. would be required and responsible to complete by June 30, 2017. Those actions can be summarized as follows: 1. All material stored on the South Site will be removed and processed or properly disposed of at a facility permitted to accept it. 2. All leachate (any water that comes into contact with waste) generated at the facility will be captured and directed to the public sewer system. 3. The Leased Site will be used only for the storage of clean mulch, made exclusively of land clearing debris and clean lumber. No grinding or processing operations, nor the storage of engineered wood waste is permitted on the Leased Site at this time. Future operations on the Leased Site will be addressed during the permit review and set forth in the revised Operations Manual. 4. A request for permit modification, including a revised Operations Manual, will be submitted to Ming-Tai Chao, Permit Engineer. The request will provide documentation and information outlined in the Notice of Violations, dated March 21, 2017, and clarified in my letter to Abbey Green, Inc., dated May 1, 2017. By June 30, 2017, Abbey Green, Inc. must either: 1. Comply with all of the requirements listed in numbers 1 through 4 above (as stated in the Notice of Violation dated March 21, 2017 and further defined in my letter dated May 1, 2017); or, 2. Submit a request for an extension of time in which to come into compliance, including justification for the additional time being requested and a detailed plan setting forth a timetable for completion of the required corrective actions. Please note that failure to comply with these requirements may lead to further tiered enforcement actions.
