STATUS OF PERMIT: Order of Approval – “Sanitary Landfill” issued by NC Division of Health Services August 8, 1975 83-001 “Demolition-Landscape Landfill” issued by Wake County, July 14, 1983 Revised Closure Plan, submitted by Titan Atlantic Group, Inc., May 1, 2002 Permit to Operate (PTO) LCID Phase 2 and T&P issued December 17, 2010 Permit To Construct (PTC) issued in conjunction with PTO PTO expired December 17, 2015 Permit renewal application submitted January 19, 2017, currently under review PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS The facility is permitted as Land Clearing and Inert Debris (LCID) Landfill and Treatment and Processing (T&P) facility. The landfill was originally permitted by Wake County. The current permitting authority is the NCDEQ - Solid Waste Section (SWS). The facility is permitted to receive waste generated in Wake County. This facility is permitted to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt. 1. A permit modification was issued by NCDENR on December 17, 2010. This Permit to Operate expired December 17, 2015. A Permit renewal application was submitted to the SWS on January 19, 2017. Permit application is currently under review. 2. The landfill is open Monday – Friday from 8:00 - 5:00 and Saturday from 9 to 3:00. The facility is secured with a locked gate when staff are not on site. The facility has proper signage. 3. The LCID operation has set a maximum disposal rate of 10,000 cubic yards per year for the LCID landfill and 57,300 cubic yards (average of 200 cubic yards per day based on 5.5 operating days per week or 280 operating days per year). The T&P operation on top of Phase-1 LCID, has a maximum processing rate of 57,300 cubic yards per year. 4. The facility site plan and operations plan were discussed. 5. The facility currently segregates different materials for treatment and processing. The facility accepts yard waste composed of high carbon nitrogen ratio material, concrete, asphalt and soil. 6. The facility has a mulch coloring system; logs are ground for that type of mulch. 7. The facility pad/landfill cap appeared to be in good condition. No holes, ruts, or areas of ponding were observed. No erosion or runoff was observed. Screening soil at the landfill Land clearing debris The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Recent heavy rains had contributed to site condition. Adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent excessive on-site erosion of the LCID. Additional cover needs to be applied as soon as areas of erosion are notice. 9. Trees need to be removed from the side slopes of the landfill within 30 days. Trees to be removed from side slopes Areas of erosion on southern slopes of LCID 10. Asphalt is accepted, ground and is used onsite for haul road maintenance. Roads onsite are well maintained. A perimeter road around the foot print of the landfill is maintained as needed but was not passible at the time of the inspection due to recent rains. 11. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks. 12. No windblown or unacceptable waste streams noted during the inspection.
