STATUS OF PERMIT:
A modification to the Permit to Construct and Operate Phase 1 of a Large Type 3 Solid Waste Compost Facility was
issued February 3, 2015. The Permit to Operate shall expire July 28, 2019.
PURPOSE OF SITE VISIT:

None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The compost facility was originally permitted in 2013 for Type 1 waste only. In 2014, the facility was permitted to
include Type 3 waste. In 2015, the permit was modified to remove the contract operator (Agromatters, LLC) and
change the facility name from Agromatters Cabarrus Organics Reclamation Facility to Cabarrus County Organics
Reclamation Facility.
2. The Permit to Construct and Operate issued February 3, 2015 is for the construction of Phase 1 for the Type 3
compost operations. Construction of Phase 2 will require a permit modification.
3. An approval to operate by the Section is required prior to commencement of the Type 3 compost operations. Please
refer to the Permit to Operate, Attachment 2: Conditions of the Permit to Construct, Permit Condition Number 4.
4. The service area for the facility includes Cabarrus county and contiguous counties.
5. The facility is secured by a locked gate at the facility entrance.
6. Access roads are of all-weather construction.
Operations Inspection of the Compost Facility:
7. Only Type 1 wastes are being accepted.
8. No unacceptable waste was observed,
9. Type 1 windrow dimensions for active composting must be limited to a maximum of 8 feet high and 14 feet wide,
and at least 15 feet spacing between rows, as specified in the application (Doc ID 19464, page 21), unless otherwise
approved by the Section as required in the Permit to Operate, Attachment 3: Conditions of Operating Permit, Permit
Condition Number 24.
10. Continue to ensure that stockpiling of all feedstocks, finished product, pre-processed wood debris and ground or
mulched wood debris is limited to a maximum of 30 feet high and 50 feet wide as required by the Permit to Operate,
Attachment 3: Conditions of Operating Permit, Permit Condition Number 25.
