Teresa Bradford, NCDE Q – Solid Waste Section Donna Wilson, NCDEQ – Solid Waste Section Perry Sugg, NCDEQ – Solid Waste Section STATUS OF PERMIT: A modification to the Permit to Operate Phase 1 and Phase 2-Cells 2A, 2B-East, 2B-West and 2C-South was issued on June 8, 2016. The Permit to Operate shall expire on March 12, 2020. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 1. 15A North Carolina Administrative Code 13B .1626(2)(a) states: “Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter and scavenging.” During the inspection, waste was observed exposed above the soil on the northwest and western side slope of Phase 2-Cell 2C North. To achieve compliance with 15A NCAC 13B .1626(2)(a), a minimum of six inches of earthen material must be provided to all inactive areas of the northwest and western side slope of Phase 2-Cell 2C North within 10-days of receipt of this inspection report. A follow-up inspection will be conducted to verify compliance. View of Phase 2-Cell 2C North. 2. 15A North Carolina Administrative Code 13B .1626(4)(a) states, “Owners and operators of all MSWLF units must ensure that: (i) The concentration of methane gas generated by the facility does not exceed 25 percent of the lower explosive limit for methane in facility structures (excluding gas control or recovery system components).” 15A North Carolina Administrative Code 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”  Attachment 1, Part IV, General Condition 7 of Permit # 04-03 (DIN26094) states: “This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in Attachment 1, “List of Documents for Approved Plan”, and which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of the Permit shall govern.” The approved Operations Plan is included in the list of Documents for the Approved Plan. As stated in Section 7.2 (Gas Migration Monitoring) of the Operations Plan revised May 2013 (DIN 19419), automatic sensors and alarms shall be installed in each on-site structure to provide continuous monitoring of building atmosphere. Review of the quarterly methane monitoring reports indicate that facility structures have not been monitored. To achieve compliance with 15A NCAC 13B. 1626(4)(a) and 15A NCAC .0203(d), within 30-days of receipt of this inspection report, facility structures must be monitored to ensure that the concentration of methane gas or other explosive gases generated by the facility does not exceed 25 percent of the lower explosive limit. Facility structures must be equipped with a continuous explosive gas detection device or monitored during the quarterly landfill gas monitoring event in accordance with the revised Landfill Gas Monitoring Plan, Section 2.1 (Monitoring Devices and Procedures) approved August 19, 2016 (DIN 26673). FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 ADDITIONAL COMMENTS 1. The facility consists of a MSWLF and a drop-off convenience area for residential waste. 2. The facility is permitted to receive solid waste generated from within the States of North Carolina and South Carolina, consistent with the local government waste management plan and with the franchise approved by the Anson County Board of Commissioners. The facility must not receive solid waste from transfer stations that accept solid waste generated in states other than North Carolina and South Carolina. 3. Proper signage was observed at the entrance of the facility. Operations Inspection of the MSWLF: 4. Waste was being placed in Phase 2, Cell 2C North. 5. The facility utilizes two tippers. 6. The working face appeared to be restricted to the smallest area feasible and compacted. 7. No unacceptable waste was observed. 8. An excessive amount of windblown litter was observed along the toe of the slope of Phase 2, Cell 2C North, but was being collected during the inspection (see picture above). Continue to ensure that all windblown waste is collected and returned to the working face at the end of each operational day. 9. The facility is permitted to use a tarp, automobile shredder fluff mixed with soil, petroleum contaminated soil and seaboard solids as alternative cover material. The facility is currently utilizing automobile shredder fluff as alternative cover material. 10. According to Mr. Fitzgerald, a portion of the western slope of the landfill was seeded approximately two weeks before the inspection. Take measures to ensure all other bare areas on the inactive portions of the landfill are also seeded. 11. All woody vegetation must be removed on the perimeter slopes. 12. The solidification area was observed. 13. Edge of waste markers were being maintained. 14. Access roads were well maintained. 15. Leachate recirculation is not being conducted. Operations Inspection of the Yard Waste Treatment and Processing (Wood Grinding)/Composting Area: 16. Several pieces of plywood were observed in the yard waste area. Take measures to ensure that unacceptable material is removed promptly. 17. Ensure that stockpiling of all feedstocks and finished product is limited to a maximum size of 30-feet high and 50-feet wide. 18. The facility is not actively composting at this time. Ground material is used within the landfill. No material is distributed to the public. Operations Inspection of the Scrap Tire Collection Area: 19. Tires were being collected in a covered trailer. Inspection of the Leachate Storage Area: 20. The leachate storage area consists of two 250,000-gallon leachate storage tanks and a newly installed leachate storage basin consisting of an inground storage tank constructed of lined cast-in-place concrete. 21. The 250,000-gallon leachate storage tanks did not contain leachate at the time of the inspection. The leachate storage tanks will be kept empty and remain available as back-up to the leachate storage basin. 22. The leachate storage basin appeared to have an adequate amount of freeboard. 23. The leachate is pumped from the leachate storage basin to the Anson County WWTP via a force main. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Reviewed the permit, operations plan, training records, waste determination records, random inspection records, quarterly methane monitoring records, scrap tire certification forms and semi-annual groundwater, surface water and leachate monitoring. 25. 335,000 gallons of leachate was discharged to the Anson County WWTP in April 2017. 26. As discussed during the inspection, the Landfill Gas Monitoring Plan (DIN 26673) approved August 19, 2016, indicates that the facility will monitor for Hydrogen Sulfide during the quarterly landfill gas monitoring events.
