On June 14, 2017, it was observed that the tanker has been emptied and receipts for disposal produced. The violation is resolved. North Carolina General Statute (NCGS) 130A-291.1 (h1) states in part: “A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department.” Cherokee Septic was in violation of NCGS 130A-291.1 (h1) because the pumper vehicle (NC Tag #YA119) was placed in service approximately in January 2017 and the North Carolina Solid Waste Section was notified on June 14, 2017. The violation is resolved and no further action is necessary. 2. 15A NCAC 13B .0844 (b) states: “All permitted septage management firms shall display decals or lettering on each side of every pumper vehicle operated by the firm. The decals or lettering shall include the name, address (town name), phone number, and septage management firm permit number. All decals or lettering on the pumper vehicle shall be no less than three inches in height and plainly visible. Identification shall be permanently attached (i.e., no removable signs). Cherokee Septic was in violation of 15A NCAC 13B .0844 (b) because on June 14, 2017 is was observed that two pumper vehicles had been placed into service with the address lettering less than 3” in height. On June 15, 2017, photographs were submitted to the Solid Waste Section indicating that the lettering had been corrected to at least 3” in height. The violation is resolved and no further action is necessary. ADDITIONAL COMMENTS 1. On May 23, 2017, it was observed that septage was being stored in a semi tanker-trailer (tanker) at Shields Dairy. A Notice of Violation (NOV) was issued on 5/26/2017 which required the immediate discontinuation of using the tanker as a septage detention or treatment facility (SDTF) and removal of the contents to a facility permitted to accept the waste. 2. The tanker was observed to be empty and receipts for the disposal of 2630 gallons on 6/9/2017 and 1580 gallons on 6/12/2017 were produced. 3. The following firm trucks were inspected: Vehicle Identification Number (VIN) NC Tag Number Capacity (gallons) 1HTSDAAN6YH281525 YA139058 2800 1HTSDAAN6WH568084 YA119 1500 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Valves and access ports appeared to be secure. Caps were present on the access ports. 6. The trucks were properly marked in accordance with the lettering requirements; with the exception of the town name. Both vehicles contained lettering less than 3” in height. 7. The vehicle with the NC tag # YA139058 had recently been placed into service within the 10-day requirement. The vehicle with the NC tag # YA119 has been in service since approximately January 2017. The required vehicle logs appeared to be in order. 8. No leaks were observed.
