STATUS OF PERMIT:
Permit to Construct and Operate issued June 30, 2010. Permit to Operate expired June 30, 2015.
PURPOSE OF SITE VISIT: Comprehensive Audit
STATUS OF PAST NOTED VIOLATIONS: NA
OBSERVED VIOLATIONS:
1. Permit to Construct and Operate was issued June 30, 2010 and expired June 30, 2015. A renewal reminder
was send November 11, 2014. The Division did not receive a response. Mr. McDonald stated that waste
has not been placed in the last 12 months and that they intend to close the facility.
Please notify Elizabeth Werner, Permitting Branch, (919) 707-8253, of intent to close the facility and to
receive guidance for proper closure procedures.

ADDITIONAL COMMENTS
1. A sign must be posted at the entrance in accordance to the rule.
2. Ensure all ruts and settled areas over the waste are graded to ensure water is not ponding on top of waste.
3. Vertical side slopes with exposed waste were observed at the landfill during the audit. Cover all waste along the
toe of the slopes and grade the area in accordance to your approved plans to ensure that water flows away
from the waste. Ensure that grading activities do not reduce separation to the seasonal high groundwater
table. Side slopes should not exceed a 3:1 ratio.
4. All exposed waste must be covered and provisions for a ground cover sufficient to restrain erosion accomplished
within 30 working days.
5. Trees and stumps on top of waste need to be cut back and vegetation needs to be mowed within 30 working
days.
6. Property lines and edge of waste should be permanently marked and visible to ensure that the buffer of 100’ is
maintained and the 13.35-acre area is not exceeded. Buffer appears to average eighty (80) feet from edge of
waste to the property line on the west slope. Waste will need to be pushed back twenty (20) feet to meet one
hundred (100) foot buffer standard.
7. 120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal
area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff
in a controlled manner.
8. Corrective measures are necessary at this site based on observations during this inspection. Corrective
measures should be completed within 30 days’ receipt of this report.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
