OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566 (1): Operational plans shall be approved and followed as specified for the facility.
2. 15A NCAC 13B .0566 (3): Solid Waste shall be restricted to the smallest area feasible and compacted as
densely as practical into cells.
3. 15A NCAC 13B .0566 (2): The facility shall only accept those solid wastes which it is permitted to receive.
4. 15A NCAC 13B .0566 (4): Adequate soil cover shall be applied monthly or when the active area reaches one
acre in size, whichever occurs first.
5. 15A NCAC 13B .0566 (3)(j): Excavation, grading and fill material side slopes shall not exceed three to one
(3:1).
6. 15A NCAC 13B .0566 (10): Surface water shall be diverted from the working face and shall not be impounded
over waste.

ADDITIONAL COMMENTS
1. Facility permit expired on January 20, 2017. Permit renewal application needs to be submitted within
thirty (30) days of receipt of this report. Please submit renewal documentation to Elizabeth Werner,
Permitting Branch, as soon as possible if you plan to continue operating the LCID landfill.
2. Unacceptable wastes (i.e.: treated lumber, vinyl, plastic, municipal solid waste, tires, painted concrete and
metal) were observed in the landfill during the inspection. All unacceptable waste must be removed and
disposed of properly at a facility permitted to receive the waste. Unacceptable waste must be removed as it is
observed and disposed of properly. Recommend employees receive training on recognizing acceptable
and unacceptable wastes.
3. The sign at the entrance sign at the entrance to the facility was correct.
4. The site was wet due the recent heavy rains; water is ponding on top of waste unit. Site must be graded in
such a manner as to allow positive drainage of surface water away from waste.
5. All exposed waste must be covered immediately and provisions for a ground cover sufficient to restrain
erosion accomplished within 30 working days.
6. Sedimentation basin was full of soil due to onsite erosion. Basin should be cleaned and returned to
operation plan specifications.
7. Vertical side slopes with exposed waste were observed at the landfill during the audit. Side slopes should
not exceed a 3:1 ratio during filling or covering operations.
8. Property lines and edge of waste should be permanently marked and visible to ensure that the buffer of
100’ is maintained. The area for cell one is 8.5-acres. The permitted acreage shall not be exceeded for the
current cell or entire landfill.
9. Required per the approved plan is a 25-foot gravel access road around the entire perimeter of the
landfill. Access road should be of all-weather construction and properly maintained.
10. 120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the
disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water
runoff in a controlled manner.
11. Corrective measures are necessary to bring the landfill into compliance and should be completed within
30 days receipt of this inspection report.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
