PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .1626 (2)(a) Cover material requirements. (a) Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. 2. 15A NCAC 13B .1626 (2)(c) Areas which will not have additional wastes placed on them for 12 months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 3. 15A NCAC 13B .1626 (7)(c) Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of MSWLF development. 4. 15A NCAC 13B .1626 (8)(e) MSWLF units shall not: (i) Cause a discharge of pollutants into waters of the United States, including wetlands, that violates any requirements of the Clean Water Act, including the National Pollutant Discharge Elimination System (NPDES) requirements, pursuant to Section 402. (ii) Cause the discharge of a nonpoint source of pollution to waters of the United States, including wetlands, that violates any requirement of an area-wide or State-wide water quality management plan that has been approved under Section 208 or 319 of the Clean Water Act, as amended. A leachate release was observed at the toe of the eastern side slope of the active MSWLF, with ponding leachate in the surface drainage channel adjacent to a drain that flows to the sediment pond. The ponding leachate must be pumped out and disposed of properly, the release stopped and impacted soils in this area as well as impacted soils in the sediment pond must be excavated and disposed of properly. Sampling protocol for the soils in the impacted area and surface water of the sediment pond must be followed. The area must be repaired to prevent future releases. Multiple leachate seeps were also observed in several areas of the closed MSW landfill during this inspection. Although leachate was not observed flowing outside of the limits of waste, at a minimum, the soils impacted by the leachate seeps should be excavated and disposed of properly in the MSWLF, the area should be investigated to reveal the cause of the seeps, then properly repaired, and provided with adequate ground cover sufficient to restrain erosion. The areas need to be monitored to ensure the repairs are adequate. Repairs to remedy these issues should be currently underway. ADDITIONAL COMMENTS 1. A violation of 15A NCAC 13B .1626 (8)(d) and (e )(i) (ii) was observed on the east side of the active MSW landfill. A separate Notice of Violation will be sent via certified mail. 2. Waste was observed protruding from all side slopes of the active MSW landfill. In accordance with 15A NCAC 13B .1626 (2) corrective actions are required. 3. There were some bare areas observed during this inspection. Bare areas need to be seeded and mulched to aid in erosion prevention. Adequate sediment control measures (structures or devices), shall be utilized to prevent onsite erosion and silt from leaving the facility. Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of MSWLF development. 4. The slopes of the landfills are to be maintained at a minimum of 4:1, with the exception of the eastern slope of the active MSW phase III which may be graded at a 3.5:1 slope as approved in the Approval of Phase III Operating Capacity Modification letter dated August 8, 2016. 5. Strongly recommend not driving heavy equipment and trucks up side slopes, to prevent slope destabilization and erosion, once intermediate cover has been placed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Per facility operations plan, the permittee must properly maintain permanent physical markers that accurately identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill facility. 7. Windblown waste was observed along the side slopes and perimeter road of the active MSWLF. At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator. Strongly recommend additional staff to mitigate windblown trash. 8. Strongly recommend additional staff to ensure waste is disposed of properly. Construction and demolition waste was disposed of in the unattended inert debris/concrete recycling area at the time of inspection. 9. Clean-out manholes/pipes should be properly covered and maintained to mitigate vectors and prevent safety issues. 10. The facility operator must complete an approved operator training course in compliance with N.C.G.S. 130A-309.25. Certifications were not checked at this time, but, insure that a certified person is on site at all times when the facility is open. 11. Corrective measures are necessary as a result of the inspection findings and should be completed within 30 days’ receipt of this report.
