The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Per 15A NCAC 13B .0566 Operational Requirements for Land Clearing and Inert Debris (LCID) Landfills (2)
The facility shall only accept those solid wastes which it is permitted to receive. Some unacceptable waste
was observed on the side slopes. Ensure that all unacceptable waste is being removed and properly
disposed as it is seen.
2. Please remember per 15A NCAC 13B .0566 (3) Solid waste shall be restricted to the smallest area feasible and
compacted as densely as practical into cells. (4) Adequate soil cover shall be applied monthly, or when the
active area reaches one acre in size, whichever occurs first. Continue to do a good job managing the
working face and apply cover as needed. Ensure your side slopes are properly covered and graded at a
3:1 ratio.
3. Ensure the area is being graded and managed for positive drainage. Some ponding water was observed
around the LCID debris. Per 15A NCAC 13B .0566 (10) Surface water shall be diverted from the working
face and shall not be impounded over waste. (11) Solid waste shall not be disposed of in water.
4. Per 15A NCAC 13B .0564 Siting Criteeria For Land Clearing and Inert Debris (LCID) Landfill
(9) The facility shall meet the following minimum buffer requirements:
(a) 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212.
(b) 100 feet from the disposal area to property lines, residential dwellings, commercial or public
buildings, and wells.
(c) Buffer requirements may be adjusted as necessary to insure adequate protection of public health and
the environment.
The pond behind the unit of waste needs to be addressed to meet the requirement of 13B 0.564 listed above.
5. The edge of waste markers and property boundary markers appear to have been damaged or removed. Please,
have the limits of waste and boundaries surveyed and reinstall edge of waste and property boundary
markers.
6. Corrective measures are necessary, as a result of this inspection.
7. Please notify me, by email at amanda.freeman@ncder.gov, once the boundary and edge of waste markers
have been installed. A follow up inspection will be conducted once notification of marker installation is
received, or after 30 days’ receipt of this report, whichever occurs first.
