ADDITIONAL COMMENTS
On May 25, 2017, John Patrone met with Bobby King, Phil Martin, Roger Maness, and Priscilla Maness to conduct a
comprehensive inspection of the Key Properties LCID Landfill and Processing Facility on Sandy Cross Road in
Burlington, Alamance County.
1. The facility is a land clearing and inert debris (LCID) landfill. The permitted LCID landfill consists of a North
Cell and a South Cell and incorporates an existing notified LCID landfill area (N0705).
2. The facility permit includes a yard waste grinding operation that is conducted atop a notified LCID landfill
(N0475). The notified LCID landfill is covered with soil and is no longer active.
3. The facility permit – the landfill and yard waste grinding operation - encompass two parcels of land. The active
landfill is on parcel No. 170356 – Lot # 1, Bk 2035 Pg 209 and the yard waste grinding operation is on parcel No.
155212 – Lot # 2, Bk 2035 Pg 209.
4. The facility has a temporary disaster debris staging site (TDDSS) associate with both parcels of land. The TDDSS
number is DS01-012.
5. The facility has not constructed the North and South Cells to date although the North Cell has been cleared of
trees.
6. The facility plans to begin construction of the North Cell in mid-July 2017.
7. Prior to construction of the North Cell contact Perry Sugg, Permitting Hydrogeologist – SWS for further
discussion.
8. Ensure Attachment 2 – Conditions of Permit to Construct are met prior to the operation of the landfill cells.
9. The facility has constructed an additional area [1.20 acres] that abuts the existing notified LCID landfill that was
incorporated into the facility permit.
10. The facility has submitted the application for the 1.20-acre area that was constructed. Contact Perry Sugg,
Permitting Hydrogeologist – SWS, at 919-707-8258 or perry.sugg@ncdenr.gov for further discussion.
11. The facility is placing LCID in the 1.20-acre area.
12. The facility is permitted to receive LCID generated within: Alamance, Caswell, Chatham, Durham Forsyth,
Guilford, Orange, Person, Randolph, Rockingham, and Wake Counties.
13. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated
soil, inert debris, and (used) asphalt.
14. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.
15. Solid waste must be covered with 1 foot of suitable soil cover at least once per month, or when the active area
reaches one acre in size, whichever occurs first.
16. A ready supply of soil should be available for cover material.
17. Excavation, grading, and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical
feet (3:1).
18. The LCID landfill facility annual report (FAR) was received by the SWS dated June 27, 2016. Estimated facility
throughput for July 2015 through June 2016 is 14,300 yd3.
19. Records were reviewed of the amount of yard waste received and processed for June 30, 2016 through May 24,
2017. The facility has 341 yd3 of unprocessed material and 1,601 yd3 of mulch on site.
20. The yard waste grinding operation FAR was received by the SWS dated July 11, 2016. Facility throughput for
July 2015 through June 2016 is 11,368 tons. The amount of yard waste and mulch on site is 1,654 yd3.
21. The facility shall not grind high nitrogen-to-carbon ratio material.
22. The facility shall not compost material.
23. There was no indication of erosion or runoff.
24. The Pleasant Grove Volunteer Fire Department, Faucette Fire Department, or the Haw River Fire Department can
be contacted to respond to an emergency at the facility.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

25. The facility has a stockpile of crushed asphalt on the property for use on access roads and for resale.
26. The facility has a small stockpile of soil and wood mix that will be screened.
27. Access roads are of all-weather construction.
28. An attendant is on duty when the facility is in operation.
29. The facility is secured by a locked gate.
30. The facility has a proper sign.
31. The PTO expiration date is April 24, 2019.
32. The permit renewal application shall be submitted to the SWS by October 24, 2018.
