The property is 351 acres and the current owners are listed in the table above. Parcel 010250 01070 has an unpermitted, former landfill (operated from approx. 1972-1986) and former wastewater neutralization pond (closed in 1996). Parcel 010262 01003 A was a used by the Laurinburg-Maxton Army Air Base (LMAAB) from 1942-1945. A map provided by Ray Livermore of the Wilmington District of the U.S. Army Core of Engineers (USACE) showed 3 UXO (unexploded ordnance) sites on the property. The three UXO sites include Area 4 (former bazooka range), Area 5 (former locations of dynamite magazines) and Area 9 (former practice grenade court). Recent sampling of groundwater monitoring wells around the former landfill and from groundwater that flowed into the landfill after the debris was excavated identified benzene, toluene, chromium, and phenol at concentrations that exceed 2L. The property is currently vacant except for the natural-gas pipeline that transects Parcel 010262 01003 A and timber that is grown and harvested on 010250 0102701 and 010250 0102701. The PD plans to redevelop the property for a feed mill and railroad spur. The applicant PD listed below have asserted that: 1) they have not caused or contributed to the contamination at the property, and 2) they have substantially complied with laws, regulations, and rules for the protection of the environment. If you have any information to suggest otherwise, please provide that information to me at james.rudder@ncdenr.gov by May 4, 2017. A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or enforce against any and all parties who caused or contributed to the contamination at the property. In fact, the BFA will require the developer to provide access to the property to any party doing work under any DEQ program. A BFA provides liability protection only to a non-causative redeveloper of the property. The developer will be required to make the property safe for its intended re-use. Cleanup to unrestricted use standards will not be required unless deemed necessary based on the developer's proposed use of the property. Furthermore, the BFA will not change the developer's responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.) as required under applicable law.
