VAN DER VAART Secretary LINDA CULPEPPER Director February 4, 2016 CERTIFIED MAIL: 7010 3090 0001 4226 3844 RETURN RECEIPT REQUESTED Mr. Harold Blaylock Blaylock Grading LLP 345 Caulton Brown Road Lillington, North Carolina 27546-7826 SUBJECT: Notice of Violation Compliance Inspection Report Blaylock Grading LCID Landfill 43C-LCID- Harnett County Dear Mr. Blaylock: On January 21, 2016, Liz Patterson and Drew Hammonds, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. David Stephens was present and represented Blaylock Grading LCID Landfill during this inspection. The following violation(s) were noted: A. 15A NCAC 13B .0566(2), “The facility shall only accept those solid wastes which it is permitted to receive.” Unaceptable waste streams were noted during the inspection. Pallets, scrap metal, tires, and any other unacceptable waste need to be removed and taken for proper disposal. Black “sand” or filter material from Water Treatment Plant has not been approved for acceptance at facility according to current permit. Based upon the foregoing, within 30 days of receipt of this Notice of Violations, Blaylock Grading LCID Landfill shall come into compliance by with all requirements of the regulations in 15A NCAC 13B .0566(2) by completing the following: 1. Remove all waste not permitted for disposal at this facility and dispose of it properly at a facility permitted to receive the waste. 2. Maintain copies of disposal tickets as proof that waste was disposed of properly. 3. Notify me once the waste has been removed and all other issues have been corrected. A follow up site inspection will be conducted after 30 days have passed to ensure that the corrective measures have been completed to bring this facility into compliance. The violation(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. In addition to the violation noted above, please note that items #10, #11, #15 and #16 on the inspection report required additional action on behalf of the facility in the next 30 days to ensure compliance is maintained at this facility. Should these items not be addressed in that time frame, the facility will be subject to future enforcement action(s). Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection to verify that the facility has completed the requirements of this Notice of Violation.
