STATUS OF PAST NOTED VIOLATIONS:
On February 15, 2017, LES was observed to be in violation of 15A North Carolina Administrative Code (NCAC)
13B .0841(g) states: “The permit holder of a septage treatment or detention facility shall control odors from the facility
at the property boundary”.
On February 15, 2017, LES was observed to be in violation of North Carolina Solid Waste Permit SDTF-34-06,
Operating Permit Condition #3 states: “The method for controlling odors described in the approved application for
this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B
.0841(g)
A Notice of Violation (NOV) was issued to LES on February 16, 2017. A response to the NOV was received by the
Solid Waste Section on February 20, 2017 describing actions to be taken for odor control. The installation of an
additional 8,000 scfm scrubber is to be completed by the end of May 2017 with the Odor and Vector Control Plan to be
updated accordingly.
The violation is not yet resolved.

ADDITIONAL COMMENTS
1. This septage treatment facility consists of one 10,000 gallon tank, one 10,000 raw material bin and three 25,000
gallon tanks for a total storage capacity of 95,000 gallons for the storage of untreated and treated septage.
2. As a reminder, LES is required to submit total coliform analysis every six months to the Solid Waste
Section and specify where in the facility operations the sample was taken.
3. The facility is permitted for the storage and treatment of grease trappings only.
4. The facility is surrounded by chain-length-fence to prevent unauthorized access.
5. No trespassing signs were located on the exterior side of the chain-length-fence.
6. All waste treatment was confined to the interior of the building.
7. The truck off-loading area was free of residues and appeared to be well maintained.
8. The misting system, located on the southern side of the building, was observed not in operation.
9. Bin waste is collected into a small dumpster and disposed by Republic Services, everything else goes into roll-
off boxes to Wallace Farms compost facility.
10. No odors were observed outside of the facility.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
