PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid waste management facility permit shall have two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct (PTC) must be implemented in accordance with Attachment 2 of this permit. The Permit Approval to Operate (PTO) must be implemented in accordance with Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. The certified copy of the permit issued on July 02, 2012 (DIN 16630) was presented and recorded in Book Number R7369 and Page Number 1058 through 1066 by Guilford County Register of Deed Office on July 13, 2012 (DIN 16902). 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill and a reference by book and page to the recordation of the permit. 5. By beginning receiving waste at the facility the permittee shall be considered to have accepted the terms and conditions of this permit. 6. Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. 8. This permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with applicable statutes and rules. 9. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 10. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. Facility Permit No. 4124-MWP-2012 Permit Approval to Operate Image First Services, LLC Medical Waste Treatment Facility Issuance Date: May 08, 2017 DIN 27709 Page 5 of 9 - End of Section- ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE PART I: GENERAL FACILITY OPERATION CONDITIONS 1. This permit shall expire July 2, 2022. Pursuant to N.C.G.S. 130A-295.8(b)(2), the permittee must submit a request to the Section for permit review and must update pertinent facility plans including, but not limited to, the facility operation. 2. Copies of this permit, the approved plans, and all records that are required to be maintained by the permittee according to the approved document (DIN 27710) must be maintained at the facility and made available to the Section upon request during normal business hours. 3. A responsible individual trained in facility operations must always be on-site during all operating hours of the facility. 4. The permittee must maintain a record of the amount of solid waste received at the facility including daily records of waste received and origins of the loads, in accordance with the approved documents (DIN 27710). Scales must be used to weigh the amount of materials received, recovered and disposed. The daily records should be summarized into a monthly report for use in the required annual reports. 5. On or before August 1 annually, the permittee must submit an annual facility report to the Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received, in tons and be compiled: i) On a monthly basis. ii) By county or city of origin. iii) By diversion to alternative management facilities. c. The completed report must be forwarded to the Regional Senior Environmental Specialist for the facility by the date due on the prescribed annual facility report form. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Senior Environmental Specialist by the date due on the prescribed annual facility report form. 6. Signs must be posted at the facility that state types of waste accepted and prohibited, operation hours, the permit number, emergency contact phone number(s), and other pertinent information. Traffic signs or markers must be provided as necessary to promote an orderly traffic pattern to maintain efficient operating conditions. 7. Pursuant to N.C.G.S. 130A-295.2, the permittee must be continuously maintained for the financial assurance duration of the facility. Closure and/or post-closure cost estimates and financial instruments must be updated annually. PART III: CONSTRUCTION AND DEMOLITION DEBRIS LANDFILL UNIT(S) Not Applicable. PART VI - TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) 4124-MWP-2012, Image First Services, LLC, a Medical Waste Treatment Facility 1. The facility is permitted to only receive medical waste and regulated medical waste as defined in N.C.G.S. 130A-290(a)(17a) and Rule 15A NCAC 13B .1201(10) and as described in the approved plan (DIN 27710). The approved waste stream shall not consist of, contain, mix, or comingle with any prohibit wastes: a. Hazardous waste and material as defined in N.C.G.S. 130A-290(a)(18) & (18a). b. Radioactive wastes as defined in 15A NCAC 13B .0101(33). c. Household waste as defined in 40 CFR 261.4(b)(1). d. PCBs as defined in 40 CFR 761. e. Any other wastes that may pose a threat to public health or the environment. The permittee is approved to operate the medical waste treatment facility and associated facility appurtenances for processing, treating and temporally storing medical waste and regulated medical waste in accordance with the approved plan (DIN 27710), the applicable Rules 15A NCAC 13B .1201 through .1207 and .1301 and the permit conditions specified herein to ensure that medical waste is transported, stored, treated, and disposed of in a manner sufficient to protect human health, safety, and welfare; and the environment. 3. This permit approves the operation of the medical waste treatment facility consisting of two (2) steam sterilization units and associated facility appurtenances for storage and processing of treated and untreated medical waste. All operating procedures shall conform to described in the approved plan (DIN 27710) and Rules 15A NCAC 13B .1207(1) & (2). 4. Medical Waste is subject to the general requirements of Rule 15A NCAC 13B .1202. 5. Regulated Medical Waste is subject to the requirements of Rule 15A NCAC 13B .1203. 6. Blood and body fluid in individual containers in volume greater than 20 millimeters shall be properly packed & labeled, temporally stored, and transported to an off-site permitted medical waste incinerator for final disposal according to applicable rules and the approved plan (DIN 27710). 7. Steam sterilization shall not be employed for treatment of pathological wastes according to Rule 15A NCAC 13B .1203(a)(3). All pathological wastes accepted at the facility shall be segregated from other medical wastes, stored in a refrigerated trailer which shall remain locked and secures, and subsequently transported to an off-site permitted medical waste incinerator, in accordance with the approved plan (DIN 27710) and all applicable sections of Rule 15A NCAC 13B .1200. 8. Transportation of untreated regulated medical waste shall conform to the requirements of Rule 15A NCAC 13B .1205. 9. Storage facilities for untreated medical waste shall be provided at the treatment facility as shown on the General Arrangement Drawing in the approved plan (DIN 27710) and in accordance with Rules 15A NCAC 13B .0104, .1206, and .1207(1). 10. Contingency plan including fire-fighting and report, spill prevention and control, transport of non-processible and/or non-conforming wastes to an approved disposal Facility Permit No. 4124-MWP-2012 Permit Approval to Operate Image First Services, LLC Medical Waste Treatment Facility Issuance Date: May 08, 2017 DIN 27709 Page 8 of 9 and/or treatment facility shall be implemented as described in the approved plan (DIN 27710). 11. The facility must not cause nuisance conditions. a. The facility must always be maintained in a clean, sanitary condition. b. The operating floor, trailer storage, unloading dock area, and storage container and area must be cleaned and disinfected after all treatment has taken place during facility operations. c. The storage of the waste must not cause any nuisance, such as odor or attraction of vectors. d. Effective vector control measures must always be applied to control any potential vectors including flies, rodents, insects, and other vermin. e. Control measures must be utilized to minimize and eliminate visible dust emissions and blowing litter. i) Fugitive dust emissions are prohibited. ii) Windblown materials must be collected by the end of the day and no windblown material may be allowed to leave the facility boundary. 12. All water that comes in contact with solid waste, including vehicle wash-down water, is leachate, as defined in Rule 15A NCAC 13B .0101(24) and must be captured and properly treated before release to the environment. a. The leachate control system, such as floor drains, leachate collection devices, sanitary sewer connections and leachate storage tanks, must be operational during facility operations. b. The operating floor must drain away from the building entrance and into the leachate collection system. 13. Treated medical waste shall be properly disposed of at a permitted municipal solid waste landfill, medical waste incinerator, or municipal solid waste incinerator as described in the approved plan (DIN 27710). 14. Reused waste containers will be washed, disinfected, and inspected for damage prior to be being returned to the customer. The Regional Senior Environmental Specialist will be notified of any plant shutdown, other than normal course of business, due to the business closing, major repairs, or similar interruptions in operation. The specialist will be given the opportunity to perform an inspection, including a demonstration showing that the facility meets the operational requirements listed in 15A NCAC 13B .1200, prior to re-opening. 16. The permittee must maintain records of all waste received at this facility for no less than three (3) years. The records shall include the information as described in the approved plan (DIN 27710).
