Dear Ben:

Please find enclosed the Permit to Construct and Operate for the Nash County C&D Landfill. This
permit issuance approves the Permit to Construct for the horizontal expansion of the landfill, and is issued
for life of site. Conditions must be met prior to operation of Phases 4 through 9, as described on page 5
of the permit.

Also enclosed is a certified copy of the permit for recordation at the Register of Deeds. The permit must
be recorded within 30 days and returned to our office, as described in condition 3 on page 2 of the permit.

In general, the new facility permit does not reiterate permit conditions which are included in the Solid
Waste Management Rules, 15A NCAC 13B, nor does it restate specific conditions which are included
within the approved plans, such as site specific operations. Please review the conditions of the permit
carefully.
