PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be
applied monthly, or when the active area reaches one acre in size, whichever occurs first.” At the time of this
inspection, the large unprocessed debris pile that had been situated to the southeast of the fire area had been sorted
to remove large logs and stumps, and compacted in the initial fill area. This grade of this fill area closely matched
the grade of the fire area, where processed wood waste had been compacted and covered.
Considerable progress was evident at the site, with obvious attention to correctly placing, compacting and
covering the waste according to the agreed upon plan. Based on the continuing effort and the dedication of
manpower and equipment to bring the facility into compliance, the deadline will be extended until May 31, 2017.

ADDITIONAL COMMENTS
1. No waste has been accepted at the site since before the fire event began on January 16, 2017.
2. Mr. Howerton stated that he had dedicated a full-time operator to the site in order to continue carrying out the
plan that had been discussed and agreed upon on January 31, 2017
3. Large logs and stumps are temporarily stockpiled to the east of the fire area, as they are separated from the land
clearing debris. Mr. Howerton explained that he intended to split this material to create firewood.
4. Mr. Howerton explained that he had separated and moved other stumps and large logs into a pile located
southwest of the parking area for this purpose as well.
5. Most of the unprocessed wood waste previously stored to the southeast of the fire area had been compacted into
a tight cell in that same area. At the time of this inspection, the site operator was working to separate and move
several large logs in order to finish compacting the cell so that clean soil cover could be applied. The grade of
this cell closely matches the grade of the fire area, where processed wood waste had been compacted, covered
and leveled.
6. Operations at the facility had been hampered by a week of heavy rain that caused mud and a lack of
maneuverable area for the excavator.
7. Mr. Howerton explained that DEMLR had recommended that he use some of his mulch stockpile to create
internal roadways for the equipment to maneuver over and berms to help direct storm water and prevent erosion
and sedimentation as the work progresses. He stated that he intends to follow that advice, and will begin to
move mulch into position when work resumes next week.
8. The desirability of permanent edge of waste markers to better ensure that waste does not exceed the designated
waste boundaries was again discussed. Mr. Howerton agreed that he would install markers along the edges of
the disposal area as fill work is completed.
9. Based on approximate measurements using aerial photography, the estimated size of the LCID operations at this
time is 1.70 acres. Should the fill area increase to a size of more than 2 acres, a full LCID landfill permit
must be obtained, as required by 15A NCAC 13B .0563(3)(b).
10. The Solid Waste Section will perform additional inspections to ensure that the facility does not exceed 2
acres in size and complies with all of the rules and operational requirements contained in 15A NCAC 13B
.0563 through .0566.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
