STATUS OF PERMIT:
A Permit Approval to Operate 0201-CDLF-1997, Alexander County CDLF and 0202T-TRANSFER-1998, Alexander
Co. Transfer Station was issued to Alexander County on February 20, 2017.
PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
15A North Carolina Administrative Code 13B .0542(f)(1) states: “Except as provided in Subparagraph (3) of this
Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material
when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent
intervals if necessary to control disease vectors, flies, odors, blowing litter, and scavenging. A notation of the date and
time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule.”
During an inspection on March 29, 2017, waste was observed exposed above the soil on a portion of the inactive southeast
facing slope of the landfill. Waste was last placed in this area on approximately February 8, 2017 according to Mr.
Mitchell. Therefore, Alexander County was found in violation of 15A NCAC 13B .0542(f)(1) in that waste was not
covered with six inches of earthen material at least once weekly as required.

15A North Carolina Administrative Code 13B .0542(g)(3) states: “Appropriate methods such as fencing and diking
must be provided within the area to confine solid waste which is subject to be blown by the wind. At the conclusion of
each operating day, all windblown material resulting from the operation must be collected and disposed of by the owner
and operator.
During an inspection on March 29, 2017, severe windblown waste was observed east and south of the working face. It
appeared that some waste had been deposited along the wind fence east of the working face for quite some time. Mr.
Mitchell confirmed that windblown waste had been deposited prior to the previous day’s operation. Therefore, Alexander
County was found in violation of 15A NCAC 13B .0542(g)(3) in that windblown waste was not collected and disposed at
the conclusion of each day of operation.
15A North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a permitted facility, the
permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit.”
x Attachment 1, Part 1, General Facility Permit Condition 6 states: “Operation of this solid waste management
facility shall be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter
130A of the North Carolina General Statutes (NCGS 13A-290, et seq.), the conditions contained in this Permit;
and the approved plan. Should the approved plan and the rules conflict, the Solid Waste Management Rules shall
take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance
action or Permit revocation.”
x The approved Operation Plan (included within the Permit Application for Continued Operation; Document ID
No. 27229) is included in the List of Documents for the Approved Plan. Item 3.2(2)(a) of the approved Operation
Plan states in part: “Except as in Subparagraph (c), the County must cover the solid waste with six inches of
earthen material when the waste disposal area exceeds one-half acre and at least once weekly.”
x Item 3.2(3)(c) of the approved Operation Plan states in part: “At the conclusion of each operating day, all
windblown material resulting from the operation will be collected and disposed of by the County.”
Alexander County was found in violation of 15A NCAC 13B .0203(d) in that solid waste was not covered with six
inches of earthen material at least once weekly and windblown material resulting from the operation was not collected
and disposed of at the conclusion of each operating day as stipulated in the approved Operation Plan.
Inspection of the facility on April 19, 2017 found good operational cover on all inactive portions of the landfill.
Windblown waste was also well controlled. Therefore, the above violations are considered resolved. Thank you
for your cooperation in this matter.
OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility consists of a Construction and Demolition Landfill located on top of a Closed, unlined MSW Landfill.
2. The facility is permitted to receive solid waste generated within Alexander County.
3. This was a partial inspection to evaluate actions taken to comply with the observed violations documented on the
previous inspection report issued to Alexander County on April 5, 2017. Please refer to “Status of Past Noted
Violations” for comments.
4. The working face was less than on-half acre in size at the time of inspection.
5. No unacceptable waste streams were observed.
6. All access roads were of all-weather construction and well maintained.
7. During the inspection, a portion of the monitoring wells were observed on site. Heavy rain at the time prevented
inspection of all remaining wells which will be inspected at a later date. Attention is needed for the following:
x MW - 1: Concrete pad is cracked and in need of repair.
x MW – 1A: Remove vegetative cover from concrete pad. A new label should be provided as information
on the current label is faded and difficult to read.
x MW – 1B: Remove vegetative cover from concrete pad.
x MW – 18: Remove vegetative cover from concrete pad.
x MW – 19: Remove vegetative cover from concrete pad.
8. LFG 1 – LFG 3 were observed during the previous inspection performed on March 29, 2017. LFG 4 and LFG 5
were observed during this inspection. All wells were found to be tagged and labeled with the exception of LFG 5.
This well did not have a proper tag. One should be provided.
x It appears that LFG 1 – LFG 5 were not included as part of the monitoring network show on the approved
Methane Monitoring Plan. A copy of this inspection report will be forwarded to Perry Sugg, Permitting
Hydrogeologist to determine if any information must be submitted detailing the status of LFG 1 – LFG 5.
