Explanation Mountaire Corporation (Mountaire) is a multi-million-dollar chicken-processing company that has operations in North Carolina, Delaware, Arkansas, and Maryland. It has annual revenues in excess of $1 billion and employs over 4,000 people. E. Does PD have or can it obtain the managerial means to fully implement a brownfields agreement and assure the safe use of the property? Answer Yes 8 Explanation Mountaire employs an engineering staff and has contracted with Duncklee & Dunham to assist them with the Brownfields Agreement (BFA) process and any associated environmental work that may be required. Mr. Josh Hanks and Mr. David Duncklee have more than 13 years of combined experience working with the North Carolina Brownfields Program (NCBP), where they have worked through the BFA process with prospective developers. Mr. Hanks will be responsible for the day-to-day management of the work associated with assisting Mountaire to obtain a BFA, and conferring with or copying Mountaire on all brownfields-related matters as they pertain to the subject property. F. Does PD have or can it obtain the technical means to fully implement a brownfields agreement and assure the safe use of the property? Answer Yes. Explanation As is currently being done at the Townsend & Acme-McCrary Site, Mountaire has contracted with Duncklee & Dunham to assist them with the BFA process and any associated environmental work that may be required. Mr. Joshua Hanks and Mr. David Duncklee have more than 13 years of combined experience working with the NCBP, where they have worked through the BFA process with prospective developers. Mr. Hanks will be responsible for the day-to-day management of the work associated with assisting Mountaire to obtain a BFA, and conferring with or copying Mountaire on all brownfields-related matters as they pertain to the subject property. Robeson County: 14.01 acres of PIN 839644921769 A map from the Scotland and Robeson County GIS website that shows these parcels is in Appendix A. 11 past use(s) Generally, the site has been used for cultivation of crops, to raise and harvest timber, and for rural residential use. The Laurinburg-Maxton Airport was originally constructed as the the Laurinburg-Maxton Army Air Base, and part of the airport parcel on the Mountaire site was used as the base's bazooka practice range, a dynamite magazine, and a practice grenade court from 1942 to 1945. The Scotland County EDC parcel contains an unpermitted landfill and a process-water pond formerly used by Johns Manville, former occupant of the adjacent Railroad Friction site (joint partners until Manville divested), at which Railroad Friction still manufactures parts for train brakes. Further details of site history are in Duncklee & Dunham's Revised Report of Phase I Environmental Site Assessement, dated March 23, 2017. current use(s) Unused except for a natural-gas pipeline that crosses the airport parcel, and to grow timber for harvesting on the Maxton Farms parcel cause(s)/source(s) of contamination: known Benzene, toluene, chromium, and phenol at concentrations that exceed the 2L standards in groundwater samples collected in monitoring wells near the landfill pit or from groundwater that flowed into the landfill pit after the debris was excavated; selenium at a concentration that exceeded the 2L standard in a sample from a temporary well constructed near the former location of the process-water pond. B. In what way(s) is the actual or possible contamination at the property a hindrance to development or redevelopment of the property (attach any supporting documentation such as letters from lending institutions)? There are known (former landfill and process water pond) and possible unknown sources of VOCs and inorganics on the former Manville parcel, and the possibility of unexploded ordnance on the airport parcel. The past and present industrial land uses on adjoining sites to the west are potential contaminant sources to the subject site. Mountaire is not a responsible party for any contamination documented or undocumented at the subject property. Mountaire intends to operate initially a feed mill if business environmental risk can be lessened. To avoid potential liability with respect to existing contamination, Mountaire wants to redevelop the property under the protection of a Brownfields Agreement (BFA). E. In what way(s) is the redevelopment of the property difficult or impossible without a brownfields agreement (attach any supporting documentation such as letters form lending institutions)? The redevelopment of this property is difficult due to the unknown sources of organic and inorganic compounds and the possible presence of unexploded ordnance on-site. F. What are the planned use(s) of the redeveloped brownfields property to which the PD will commit? Be as specific as specific as possible. Mountaire plans to construct a feed mill initially. A railroad spur will be constructed over the former locations of the process-water pond, landfill, and bazooka range. Mountaire may construct water-supply wells on the property to supply water for the manufacture of feed. G. List and describe the public benefits that will result from the property’s redevelopment. Be as specific as possible. (Examples of public benefits for brownfields projects include job creation, tax base increases, revitalization of blighted areas, preserved green space, preserved historic places, improving disadvantaged neighborhood quality-of-life related retail shopping opportunities, affordable housing, environmental cleanup activities or set asides that have community or environmental benefits. In gauging public benefit, NCBP places great value upon letters of support from community groups and local government that describe anticipated improvements in quality of life for neighboring communities that the project will bring about. The inclusion of such support letters with this application is recommended and encouraged.) Public benefits will include the creation of approximately 65 new jobs, an investment in improvements and specialized equipment of approximately $43,800,000, and the redevelopment of 592.11 acres of unused property in Scotland County a large portion of which is included in this application. Special Note: Please describe all environment-friendly technologies and designs PD plans to utilize in its redevelopment strategy. For example, environment friendly redevelopment plans could include: Leadership in Energy and Environmental Design (LEED) Certification, green building materials; green landscaping techniques such as using drought resistant plants; energy efficient designs, materials, appliances, machinery, etc.; renewable sources of energy, and/or recycling/reuse of old building materials such as brick or wood. The redevelopment strategy will include a design for stormwater management. The feed mill will utilitze a boiler treatment system to treat waste water. This method of water treatment will save on fuel and water usage. The railroad spur will hold ninety car trains with the capacity of six tractor trailer loads. The use of railroad cars over trucks for bulk delivery of supplies will reduce fuel costs and damage to surrounding roads over time. J. Brownfields Affidavit: PD must provide its certification, in the form of a signed and notarized original of the unmodified model brownfields affidavit provided by NCBP, that it did not cause or contribute to contamination at the property and that it meets all other statutory eligibility requirements. (Note: The form to use for this affidavit is attached to this application. An original hard copy of this affidavit must be filled out, signed, notarized and submitted with this application.) Proposed Brownfields Agreement Form: PD must provide the completed form Proposed Brownfields Agreement. (Note: The form to use for this document is attached to this application. (Note: these maps can be purchased through the above link, or often through retail outdoor recreation stores that can print out the relevant map. Often environmental reports have location maps that use this type of map format as the base for its location map.) Is the required location map included with this application? Survey Plat: PD must provide a preliminary survey plat of the brownfields property with the property boundaries clearly identified, and a metes and bounds legal description that matches the property description on the plat. At this stage of the brownfields process, one or more existing survey plats from a previous property conveyance will suffice. (Before the brownfields project enters the public comment phase of the brownfields process, the PD will be required to submit a final brownfields survey plat which includes the information listed in the brownfields survey plat guidance.)
