REGAN Secretary MICHAEL SCOTT Director April 21, 2017    CERTIFIED MAIL   RETURN RECEIPT REQUESTED     Bailey’s Septic Tank Service  Mr. Leroy Glenn Bailey  P.O. Box 925  Knightdale, NC  27545     SUBJECT:  Notice of Violation    Compliance Inspection Report    Bailey’s Septic Tank Service    SLAS 35‐09    Franklin County    Dear Mr. Bailey:    On April 5, 2017, Connie S. Wylie, representing the State of North Carolina, Division of Waste  Management Solid Waste Section (Section), inspected the above referenced facility for  compliance with North Carolina solid waste statutes and rules.  The following violation was  noted:    1. A. 15A NCAC 13B .0838(c)   (1) Domestic septage shall be treated in accordance with the requirements in 40 CFR 503 Subpart D. (2) Grease septage, treated grease septage, commercial or industrial treatment plant septage and commercial/industrial septage shall be treated in accordance with 40 CFR 257.3-6 or treated by an equivalent or more stringent process in 40 CFR 503 Subpart D. Permit condition 6 Domestic septage ph shall be raised to 12 or higher by alkali addition and, without the addition of additional alkali, shall remain at 12 or higher for 30 minutes prior to land application. Grease septage or grease septage mixed with domestic septage, shall be raised to pH 12 or higher by alkali addition and, without the addition of additional alkali, shall remain at 12 or higher for two hours prior to land application.   Checked the pH of a recent spray path on field 1 in several areas with litmus paper. The pH was 6 and not the required 12 for land application to occur. Also noted an odor. Discussed the violation with Mr. Bailey by email who stated the lime stabilization had occurred a few days before the actual discharge event.            Bailey’s Septic Tank Service  Notice of Violation  Page 2 of 2    April 21, 2017      State of North Carolina | Environmental Quality | Waste Management 217 West Jones Street | 1646 Mail Service Center | Raleigh, NC 27699-1646 919 707 8200   Based upon the foregoing, Bailey’s Septic Tank Service shall immediately come into compliance  with all requirements of the regulations in 15A NCAC 13B .0838(c)(1&2) & Permit Condition 6 by  completing the following:    Implement changes to the procedure to ensure that adequate lime stabilization is obtained per Rule .0838(c) – Obtain pH 12 and hold for the required amount of time. The pH shall be checked again on site immediately prior to the discharge event. If a pH 12 is not present then land application shall not occur at that time and the lime stabilization procedure shall be redone.    The violation listed above was observed by Section staff and require action on behalf of the  facility in order to come into or maintain compliance with the Statutes, Rules, and/or other  regulatory requirements applicable to this facility.  Be advised that pursuant to N.C.G.S. 130A‐22,  an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid  Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the  N.C. General Statutes.  Further, the facility and/or all responsible parties may also be subject to  enforcement actions including penalties, injunction from operation of a solid waste management  facility or a solid waste collection service and any such further relief as may be necessary to  achieve compliance with the North Carolina Solid Waste Management Act and Rules.    Please keep me informed of your progress in this matter.  If you have any questions please  contact me at 910‐433‐3352 or e‐mail connie.wylie@ncdenr.gov.    Sincerely,        Connie S. Wylie  Soil Scientist  Division of Waste Management ‐ Solid Waste Section
