Transfer Station was issued to Alexander County on February 20, 2017. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A North Carolina Administrative Code 13B .0542(f)(1) states: “Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, flies, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule.” During the inspection, waste was observed exposed above the soil on a portion of the inactive southeast facing slope of the landfill. Waste was last placed in this area on approximately February 8, 2017 according to Mr. Mitchell. Therefore, Alexander County is in violation of 15A NCAC 13B .0542(f)(1) in that waste was not covered with six inches of earthen material at least once weekly as required. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 15A North Carolina Administrative Code 13B .0542(g)(3) states: “Appropriate methods such as fencing and diking must be provided within the area to confine solid waste which is subject to be blown by the wind. At the conclusion of each operating day, all windblown material resulting from the operation must be collected and disposed of by the owner and operator. During the inspection, severe windblown waste was observed east and south of the working face. It appeared that some waste had been deposited along the wind fence east of the working face for quite some time. Mr. Mitchell confirmed that windblown waste had been deposited prior to the previous day’s operation. Therefore, Alexander County is in violation of 15A NCAC 13B .0542(g)(3) in that windblown waste was collected and disposed at the conclusion of each day of operation. 15A North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” x Attachment 1, Part 1, General Facility Permit Condition 6 states: “Operation of this solid waste management facility shall be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 13A-290, et seq.), the conditions contained in this Permit; and the approved plan. Should the approved plan and the rules conflict, the Solid Waste Management Rules shall take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance action or Permit revocation.” x The approved Operation Plan (included within the Permit Application for Continued Operation; Document ID No. 27229) is included in the List of Documents for the Approved Plan. Item 3.2(2)(a) of the approved Operation Plan states in part: “Except as in Subparagraph (c), the County must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly.” x Item 3.2(3)(c) of the approved Operation Plan states in part: “At the conclusion of each operating day, all windblown material resulting from the operation will be collected and disposed of by the County.” Alexander County is in violation of 15A NCAC 13B .0203(d) in that solid waste was not covered with six inches of earthen material at least once weekly and windblown material resulting from the operation was not collected and disposed of at the conclusion of each operating day as stipulated in the approved Operation Plan. Gerstell) To achieve compliance, within 15-days of receipt of this inspection report, all waste must be covered with six-inches of earthen material and all windblown waste must be collected and properly disposed. ADDITIONAL COMMENTS 1. The facility consists of a Construction and Demolition Landfill located on top of a Closed, unlined MSW Landfill. 2. The facility is permitted to receive solid waste generated within Alexander County. 3. The facility had proper signage. Records Review: 4. The Permit to Operate and the Operations Plan were verified. Both documents were current and available upon request. 5. Waste tonnage reports were verified for April 2016 through February 2017. The facility received 30888.39 tons of waste during this time period. 6. Groundwater and surface water monitoring was being performed semi-annually as required. First semi-annual monitoring results for 2016 (performed January 5-7, 2016) and second semi-annual monitoring results for 2016 (performed July 1, 5-6 and Sept. 22, 2016) were verified. 7. Methane and hydrogen sulfide monitoring was being performed quarterly as required. Monitoring reports for events performed on 3/25/16, 6/22/16, 9/22/16, 12/22/16, and 3/9/17 were verified. x Please ensure that hydrogen sulfide is reported in “% Volume” as stipulated in the approved Landfill Gas Monitoring Plan. 8. Waste screening reports from April 26, 2016 to present were verified. It appeared that screenings were performed with good frequency and appeared to represent 1% of the waste stream. 9. A soil cover log was being maintained. The document noted the date and number of loads of soil placed on the landfill. Please ensure that in the future, soil cover records document both the date and time of cover placement as required by 15A North Carolina Administrative Code 13B .0542(f)(1) and .0542(n)(1)(F). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Waste was being placed within Phase 1 of the CDLF at the time of inspection. 12. The working face was less than on-half acre in size at the time of inspection. 13. No unacceptable waste streams were observed. 14. The inactive north facing slope of the landfill had good operational cover and had been seeded with some germination of seed. Continue efforts to stabilize all inactive areas with a groundcover sufficient to restrain erosion. 15. Slight surface erosion was observed on the north and west facing slopes of the landfill. Any erosion must be repaired and efforts made to stabilize these areas with sufficient groundcover. 16. All access roads were of all-weather construction and well maintained. 17. A landfill collection control system consisting of three landfill gas extraction wells (MEW-1, MEW-2, and MEW- 3) and a blower system is located along the north side of the closed MSWLF and has been in operation since November 2012. However, this system does not appear to be consistent with the active methane gas system originally approved as part of the Corrective Action Plan (CAP) and subsequent addendums which included the installation of 10 landfill gas extraction wells and a flare. The previous inspection report requested that Alexander County contact Jackie Drummond, Compliance Hydrogeologist to provide an update of any changes in the approved CAP implementation. x During the March 29, 2017 inspection, Mr. Mitchell stated that the aforementioned request was to be addressed in the Corrective Action Evaluation Report which was to be submitted by April 1, 2017. x A Corrective Action Evaluation Report was submitted to the Solid Waste Section on April 3, 2017.
