STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was received by the Solid Waste section on June 9, 2016. The
Notification was filed for recordation with the Ashe County Register of Deeds on June 8, 2016.
PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
15A North Carolina Administrative Code 13B .0566(2) states: “The facility shall only accept those solid wastes which
it is permitted to receive.”
During an inspection performed on February 22, 2017, multiple shingles, pieces of metal, a metal window screen, a
piece of painted wood, a metal food can, and sheet plastic or silt fence were observed within the working face. The
aforementioned wastes are unacceptable for disposal in a Land Clearing and Inert Debris Landfill. Therefore, Anthony
Brinegar was found in violation of 15A NCAC 13B .0566(2).
Inspection of the facility on April 12, 2017 found no unacceptable waste streams within the working face. Mr. Brinegar
stated that all unacceptable waste previously observed was removed and taken to the Ashe County Landfill (permit #
05-01). Therefore, this violation is considered resolved.

OBSERVED VIOLATIONS:
None
ADDITIONAL COMMENTS
1. The facility is located on a 48.96-acre parcel of land located on Hudler Town Road and is owned by Keith A. &
Tammy L. Huffman.
2. This inspection was performed to evaluate actions taken to comply with the observed violations documented on the
previous inspection report issued on February 27, 2017. Please refer to “Status of Past Noted Violations” for
comments.
3. During the previous inspection, no sign was posted at the facility entrance as required by 15A NCAC 13B
.0566(16). Mr. Brinegar stated during the April 12th inspection that a sign had been ordered and was to be picked
up that day and installed. A picture of the sign was observed while on site which appeared to be provide the proper
information.
4. A gate was located at the entrance to the facility to prevent unauthorized access.
5. A diversion ditch was being maintained above the working face to divert surface water from the waste area.
6. The waste area appeared to be less than two acres in size.
7. A skimmer basin had been provided southeast of the working face. Water was flowing from the primary spillway
at the time of inspection.
8. During the inspection, laps and limbs cut from the property were observed in the drainage area just above the
skimmer basin. Mr. Brinegar stated that he planned to leave this material in place as a brush barrier to slow
sedimentation leading toward the skimmer basin. Upon discussion with Land Quality Section Staff, this practice
appears to be acceptable at this time. However, no off-site generated wood debris may be used for such
purposes. Once the laps and limbs currently in place have broken down and are no longer usable, the material
must be disposed of in the working face.
9. It appeared that all waste was located within the required buffer limits. During the inspection, Mr. Binegar stated
that the property line along Hudler Town Road was located at the centerline of the road. Discussion with Ashe
County Tax Office staff appeared to confirm the location of the property line as stated by Mr. Brinegar. Please
ensure that all waste activities remain 100-feet from all property lines.
10. Installation of edge of waste markers was discussed with Mr. Brinegar during the inspection.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
