PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first”. Mills LCID Landfill is in violation of 15A NCAC 13B .0566(4) for failure to apply adequate soil cover monthly, or when the active area reached one acre in size. During the inspection, a large amount of waste was exposed and covered the majority working face. Mr. Mills stated the debris had been delivered within the past 60-90 days without being covered within that time frame. Tuckers Hauling and Grading was scheduled to be on-site the day of the inspection to begin applying cover. To achieve compliance, Mills LCID Landfill must apply adequate soil cover monthly, or when the active area reaches one acre in size, whichever occurs first. A follow up inspection will be conducted in 30 days to verify adequate soil cover. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. Site consists of a Notified Land Clearing and Inert Landfill. The facility is approved for the disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood and yard trash. 2. A sign has been provided at the entrance of the site detailing acceptable wastes and contact names and phone numbers for emergencies. 3. Access to the site is secured by a gate. 4. An attendant was on duty at the time of the inspection. 5. The access road into the site was in good condition at the time of the inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Ensure all burned waste along toe of slope on the east and northeast side has adequate cover. 7. No edge of waste markers observed and mentioned to Mr. Mills about installing them. 8. Sediment basin on north side has been overtopped with sediment. Sediment observed in drainage feature beyond basin. Please repair sediment basin to original design. 9. T&P area is located adjacent to the LCID. No waste stored in area at the time of the inspection. 10. Need to periodically remove compacted wood waste from grinding operations at T&P area to LCID. 11. Hot water heater, washer, refrigerator and other scrap metal were observed on the far west side of property. Mr. Mills explained that this area was used for temporary storage of metals and is removed periodically for proper disposal.
