STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with the conditions of the permit.” Permit to Operate No. 2909-LCID-2013, Attachment 2, Conditions
of Permit to Construct, Part I, facility specific condition 3.d. states, “The disposal unit boundary must be
accurately identified with permanent markers.” Permit to Operate No. 2909-LCID-2013, Attachment 3,
Conditions of Permit to Operate, Part I, facility specific condition 7 states, “The permanent markers that
accurately delineate the waste disposal boundary must be maintained.”
On April 7, 2017, Mr. Phillips pointed out orange metal stakes that had been installed on the eastern side of the
mined area. He explained that these stakes delineate the current edge of the landfill area. There were no stakes

installed on the other edges of the landfill. By May 15, 2017, ensure that permanent edge of waste markers
are installed to delineate the waste boundary of the approved 3.887-acre fill area, as designated in the
approved site plan, dated September 4, 2012.
2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with the conditions of the permit.” Permit to Operate No. 2909-LCID-2013, Attachment 3, Conditions of
Permit to Operate, Part I, facility specific condition 8 states, “Excavation, grading and fill material side slopes
must not exceed a ratio of three horizontal feet to one vertical foot (3:1).
On April 7, 2017, the slopes of the mined area and the fill area were observed to be almost unchanged from the
previous inspection. Mr. Phillips stated that he was working to reduce the slopes, but referred only to the fill area.
Technical assistance was provided to explain that a slope ratio of 3:1 is required to be able to maneuver
equipment across a slope to properly compact waste, and to stabilize slopes to prevent erosion and sedimentation.
By May 15, 2017, ensure that the slope of the working face, the side slopes of the fill area and the side slopes
of the excavated area do not exceed a ratio of 3:1.
3. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be
applied monthly, or when the active area reaches one acre in size, whichever occurs first.”
On April 7, 2017, it was not possible to observe the portion of the fill area that had been covered within the past
30 days. The working face was almost vertical and no fill progression was visible. Adequate cover requires that
no waste is visible through the soil and that the soil is at least 12” deep. Immediately start a cover log
indicating the date, the area of fill, and size of the area that was covered; and, keep the log available at the
site for review as requested by Solid Waste Section Staff.
4. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(3) states: “Solid waste shall be restricted to
the smallest area feasible and compacted as densely as practical into cells.”
On April 7, 2017, the working face and side slopes of the fill area were observed to be very steep, still greatly
exceeding the 3:1 maximum ratio. Mr. Phillips explained that equipment is used to push the material over the
edge into the fill area, and to compact the material on the working face from the bottom of the slope. On a steep
slope, it is not possible to operate the equipment needed to sufficiently compact waste into the smallest possible
area. By May 15, 2017, regrade all slopes in the fill area to a steepness not exceeding 3:1, and compact all of
the waste in the fill area as densely as possible so that it takes up the least amount of space.
OBSERVED VIOLATIONS:
No new violations were observed.
ADDITIONAL COMMENTS
1. The facility is inspected by the Division of Energy, Mineral and Land Resources (DEMLR).
2. Since the previous inspection, several large piles of soil mixed with concrete and asphalt had been removed
from the material storage area and screened. This has created room to maneuver on the site. Mr. Johnson
pointed out that he had been able to widen and compact the access roadway so that it will remain stable in all
weather.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. Stockpiles of unprocessed mixed debris are stored southeast of the entrance gate. Parts of this storage area had
been damaged by vehicle and equipment tires, and some ponding of water was visible in these spots. Ensure
that site maintenance is performed to eliminate the ponding of water.
4. Unacceptable wastes were observed on the unprocessed mixed debris piles, including metal, paper and plastics.
Ensure that loads are adequately screened to eliminate the acceptance of prohibited wastes. Immediately
remove all prohibited waste from the unprocessed mixed debris stored on the site.
5. Stockpiles of soil, topsoil and crushed concrete had been established near the crusher on the southern end of the
site. A small pile of waste removed during the crushing process was observed next to the crusher. Ensure that
all waste is collected daily and stored in a covered, watertight container until removed for proper
disposal at a permitted facility.
6. A large amount of unprocessed wood waste was observed adjacent to the top of the working face. Mr. Phillips
stated that this waste had been accumulating for approximately two weeks. Ensure that accumulated waste is
pushed onto the working face regularly, and compacted as soon as it is placed in the landfill. It is
recommended that waste be placed in the landfill in small amounts so that maximum compaction can be
achieved before additional waste is added.
7. The slope of the current working face was observed to be near vertical at the time of the inspection. In order to
prevent fire, achieve maximum compaction, and allow the safe operation of equipment, ensure that the
excavation, grading and fill material slopes do not exceed a ratio of 3:1. (See violations listed above for
additional information.)
8. Ensure that the mined area and the base of the working face are properly graded so as not to collect
storm water.
9. Ensure that the unacceptable waste and windblown trash is collected throughout the site during each
work day and that prohibited materials, including trash, tires, construction and demolition waste, etc.,
are segregated and stored, if necessary, in covered containers prior to removal to a permitted disposal
facility.
