OBSERVED VIOLATIONS:
1. RESOLVED: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s)
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit.” Permit to Operate No. 3409-TP, Attachment 3, PART I: Yard Waste & Wood Waste Management
Operation permit condition 4 states, “A sign must be maintained at the site entrance providing site information
including the permit number, prohibited materials, and emergency contact information.”
The City of Winston-Salem is in violation of 15A NCAC 13B .0203(d) for failing to maintain a sign at the
site entrance that provides the site information required in Permit to Operate 3409-TP.

An inspection of the signage at the entrance to the facility on April 10, 2017 revealed that the following
information was not posted: permit number, prohibited materials and emergency contact information.
The facility signage was observed following the inspection while exiting the site. Mr. Turner had left the site
shortly beforehand. The signage observed on the entrance gate listed only hours of operation and the address of
the facility. In a follow-up telephone call, Mr. Turner stated that a new sign had been ordered that would
comply with the permit provisions, and that installation of the new sign would be completed on April 12, 2017.
Mr. Turner provided a photograph showing the new sign after installation at the facility entrance.
ADDITIONAL COMMENTS
1. In September 2015, the City of Winston-Salem changed operations from a Large Type 1 Compost Facility to a
treatment and processing facility for wood waste. Composting no longer takes place at the facility. However, a
small stockpile of compost remains on the site, where it is made available for sale to the public. Mr. Turner
stated that once this stockpile has been depleted, no additional compost will be brought to the site.
2. The facility is permitted to receive wood waste, including yard waste, unpainted and untreated wood waste
(including wood pallets), woody waste from disaster debris management and land clearing activities, leaves and
grass clippings.
3. Customers enter the site and pass over the scales, where city staff examine the load using closed circuit
cameras. If the load is deemed acceptable, the customer is directed to a tipping area to unload waste. Small
vehicles and residents are directed to a small area in the lower section of the facility and larger commercial
vehicles are directed to a tipping area in the upper section of the facility near the permanently installed electric
grinder.
4. The City of Winston-Salem contracts with Wallace Farms, Inc. to manage the wood waste operations at the
facility. In turn, Wallace Farms, Inc. sub-contracts with Wrico, Inc. to handle the day-to-day operation of the
site. Wrico’s primary responsibility is to assist customers, screen incoming loads, segregate and properly

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

dispose of unacceptable waste, stockpile ground materials, and load trailers on behalf of Wallace Farms, Inc.
5. Because no composting takes place at the facility, Wallace Farms, Inc. grinds and transfers all yard trash and
yard waste capable of being composted to its facility in Davie County. Only boiler fuel and mulch products are
produced at the facility.
6. The facility was observed to be well maintained and free from windblown litter. The majority of the site is
paved, with the exception of several planting areas and a bank that is situated between the lower and upper
operations areas.
7. Access roadways are paved, and no ponding water was observed in any of the operations or storage areas.
8. Storm water disperses and sheet flows across the site. No evidence of erosion or sedimentation was visible
during this inspection.
9. The facility appeared to be in compliance with required setbacks.
10. The facility is surrounded by a chain link fence, with a locking gate at the entrance.
11. Signage at the facility entrance is not sufficient to meet permit condition. (Please see observed violation in this
report for more information.)
12. During this inspection, equipment outfitted with a large shear was in operation, shearing wood waste to a size
capable of being processed in the large electric grinder. However, no grinding operations were taking place at
this time.
13. The storage areas contained piles of processed and unprocessed material. The piles appeared to meet the size
limitations specified in the Permit to Operate.
14. A roll-off container is located on the north side of the site near the entrance gate. The container is used to collect
any unacceptable wastes found in the loads after they are dropped off at the site. The container is emptied at
Hanes Mill Landfill (permit no. 3402). Mr. Turner stated that if unacceptable waste is found prior to the vehicle
leaving the site, it is returned to the vehicle for proper disposal at a permitted facility.
15. During this inspection, a small pile of scrap tires (6-10 tires) was observed next to the roll-off container. Mr.
Turner stated that the tires had been found mixed with a load. He added that they would be taken to Hanes Mill
Landfill for proper disposal.
16. Tonnage records were reviewed for the period July 2014 through March 2017. In fiscal year 2014-15, a total of
17,548.38 tons of material were accepted at the site; in fiscal year 2015-16, a total of 20,912.93 tons were
accepted; and, in fiscal year 2016-17, a total of 14,491.68 tons have been accepted through March 31.
