Submit request for permit review no later than 11/28/17. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B. 1626(7)(a) cited for failure to prevent silt from leaving the MSWLF facility. No silt was observed leaving the landfill and vegetative cover has become established on the landfill cap. 2. RESOLVED: 15A NCAC 13B. 1626(7)(b) cited for failure to prevent on-site erosion. After the sixth attempt at repairing and seeding the landfill cap, a vegetative cover has become established and the slopes of the landfill appeared to be stable. No evidence of erosion was observed during this inspection. 3. RESOLVED: 15A NCAC 13B. 1626(7)(c) cited for failure to provide for a vegetative cover sufficient to restrain erosion within 30 working days or 120 calendar days of completion of any phase of MSWLF development. During this inspection, all of the landfill cap was observed to have an established vegetative cover. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: No additional violations were observed during this inspection. ADDITIONAL COMMENTS 1. Windblown litter was observed to be controlled at the facility. Mr. Sink stated that he’d been given the use of a sheriff’s inmate labor crew to collect windblown material daily, as required by 15 NCAC 13B .1626(11)(c). 2. The initial lift in the new landfill cell was observed to be more than half filled. 3. Heavy rain had damaged the access road and tipping area for the new cell, resulting in mud and rutting from the heavy trucks. Repairs to this area were taking place during this inspection. 4. The final 24” of soil cover had been placed over the geosynthetic cap material on the closed C&D landfill, and seeding had taken place. The slopes of the landfill were already green, and preparation for the seeding of the top was underway at the time of this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
