Highway 194 North Boone, NC 28607 PARTICIPANTS: Troy Harrison, NC Solid Waste Section STATUS OF PERMIT: Active Issued: June 4, 2015 Expires: December 23, 2017 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0203(d) and 15A NCAC 13B .1406(1)(A) On 10/2/2014 and 10/3/2014 an area of landfilled compost was observed on the permit holder’s property, located approximately 400 feet northwest of the compost facility. The landfilling of septage compost was not in the approved plans for the facility. The approved plans state that compost produced at the compost facility was to be used as a compost product. The facility was required to come into compliance by removing landfilled material that could be identified as compost material (distinguishable from soil) and any buried wastes. A Notice of Violation (NOV) was issued on November 8, 2014. A Notice of Continuing Violation (NOCV) was issued on June 18, 2015. A soil probe was used to sample the final area that contained landfilled compost during a previous inspection on 6/1/2015. The soil was soft but did not appear to contain compost material. The NOV and NOCV is resolved. OBSERVED VIOLATIONS: N/A FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The facility is a Small Type III Solid Waste Compost Facility, which was operated as Composting Pilot Project (SWCD-95-01) prior to the issuance of the permit. The compost facility is operated to compost dewatered septage, including and grease septage. 2. The facility is operated at the same location as a permitted Septage Detention and Treatment Facility (Permit SDTF-95-01). The two facilities share the same entrance/gate and access roads. 3. No odors were detected at the entrance and property lines. 4. Composting was in process during the inspection. Compost in the curing stage was stored up-gradient of the composting operations. Compost was in process in bays. 5. Leachate is normally captured at the entrance of the composting bays and pumped back into the system. Leachate was observed pooled in low areas below the compost bins. There was no evidence observed that the leachate left the composting area. The area appeared to have received heavy rain just before the inspection, however; it is important that the leachate pumping system be kept in good working order. 6. There was no evidence of erosion or movement of silt or contaminants from the site. 7. The access road was well maintained with a locked gate. A “NO TRESPASSING” sign was posted at the site entrance. 8. Facility setbacks were maintained from exterior property lines. No changes were observed compared to the previous inspection regarding setbacks. The Septage Detention and Treatment Facility and the compost facility operate on two adjoining properties owned by the each of the permit holders. The property line was addressed in the original permitting action. 9. The soil was soft but did not appear to contain compost material. 10. 15A NCAC 13B .1408 requires: “The compost product from Type 2, 3, and 4 facilities shall be sampled and analyzed as follows: (1) A composite sample of the compost produced at each compost facility shall be analyzed at intervals of every 20,000 tons of compost produced or every six months, whichever comes first, for test parameters for each Type of facility as designated in Table 3 of this Rule. Standard methods equivalent to those in Table 3 may be approved by the Division.” In addition: “Compost containing sewage sludge shall be The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 tested in accordance with 40 CFR 503, Subpart B.” Please submit by July 22, 2016, the dates the samples were taken starting from July 1, 2015 and the most recent test results. 11. It is the Solid Waste Sections’ understanding that composted material is not sold or given to the public but transported to the Foothills Regional MSW Landfill (Foothills). Please provide by July 22, 2016, landfill tickets from Foothills landfill for disposal beginning January 1, 2016.
