CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” At the time of this inspection, considerable progress had been made at the site. The fire area had been cleared and excavated, and the partially burned stockpile of processed wood waste had been compacted and covered in this area. The area to the southeast of the fire had been targeted by Mr. Howerton as the initial fill area. Here, excavation had taken place surrounding the unprocessed wood waste pile, and waste was being compacted and covered as the excavation was progressing. Although major progress has been made at the site, excavation, compacting waste and applying adequate cover will take additional time. Based on the immediate response to the Notice of Violation and the sustained effort and dedication of manpower and equipment working to bring the facility into compliance, the deadline will be extended until April 30, 2017. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. No waste has been accepted at the site since before the fire event began on January 16, 2017. 2. Mr. Howerton guided us through the site and explained the work that was underway. He stated that he had been implementing the plan discussed on January 31, 2017, to excavate small cells and fill them, allowing him to clear areas, gain cover soil and have room to move the wood debris stockpiles as needed. 3. The parking area and the expanse to the southwest that had been cleared of wood debris and leveled are now being used to store wood waste removed from areas being excavated. 4. Mr. Howerton explained that he had moved some of the partially burned stumps and large logs into piles to the southwest of the parking area for this purpose as well. 5. Approximately 25% to 35% of the processed and unprocessed wood waste appeared to have been buried by the time of this inspection. 6. The area of the fire had been used to bury some of the processed wood waste involved in the fire. This area is now clear, well compacted and level. Mr. Howerton stated his intentions to add some additional fill to this area, if needed. 7. The large unprocessed wood stockpile situated southeast of the fire area was the current area of operations. Excavation had been proceeding along this pile, and waste was being compacted and covered as the excavation moved forward. 8. At the time of this inspection, operations had been halted due to equipment failure. Mr. Howerton stated that he was awaiting replacement parts that, due to the age of the equipment, had to be fabricated. He added that work would begin again as soon as the equipment was operational. 9. Mr. Howerton stated that DEMLR had been to the site to inspect erosion control devices and temporary measures that had been instituted since the fire. 10. It is recommended that permanent edge of waste markers be installed at the facility to ensure that waste does not exceed the designated waste boundaries. 11. Based on approximate measurements using aerial photography, the estimated size of the LCID operations at this time is 1.70 acres. Should the fill area increase to a size of more than 2 acres, a full LCID landfill permit must be obtained, as required by 15A NCAC 13B .0563(3)(b). 12. The Solid Waste Section will perform additional inspections to ensure that the facility does not exceed 2 acres in size and complies with all of the rules and operational requirements contained in 15A NCAC 13B .0563 through .0566. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
