Submit request for permit review no later than 11/28/17. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(a) cited for failure to prevent silt from leaving the MSWLF facility. No silt was observed leaving the landfill on this date. Slope repairs continue to be made as the vegetative cover becomes established. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(b) cited for failure to prevent on- site erosion. Many areas of the landfill cap were observed to be green, with vegetation gradually taking hold. Mr. Sink stated that spot seeding had again been undertaken in several areas where the January snow had caused damage to the slope and the sprouting vegetation. 3. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(c) cited for failure to provide for a vegetative cover sufficient to restrain erosion within 30 working days or 120 calendar days of completion of FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 any phase of MSWLF development. Slope repairs have been completed, spot seeding has taken place, and the vegetative cover is becoming established. SUMMARY OF VIOLATIONS AND CORRECTIVE MEASURES: The previously observed violations addressed above relate to erosion and sedimentation control at the MSW landfill. Although corrective measures were undertaken immediately after the initial inspection on June 2, 2016, a series of heavy rain events washed away the cover that had been added to the side slopes, and, combined with a 60-day dry spell, had eliminated the seeding that had been done on four separate occasions. The fifth attempt at re-seeding seems to be succeeding. Another inspection will be made after March 31, 2017, the deadline established for demonstrating compliance through established vegetative cover on Area 1 and Area 2/Cell 1 of the active MSW landfill. OBSERVED VIOLATIONS: No additional violations were observed during this inspection. ADDITIONAL COMMENTS 1. Windblown litter was observed to be well controlled at the facility. Mr. Sink stated that he’d been able to bring in some part-time labor as well as a sheriff’s inmate labor crew to collect windblown material daily, as required by 15 NCAC 13B .1626(11)(c). 2. Rock crushing operations that were underway at the time of the last inspection had been completed. Mr. Sink stated that he had additional rock that would be crushed at a later date. He added that the crushing operation had netted a significant stockpile of stone and gravel for use at the facility. 3. The soil layer atop the closed C&D landfill had been completed, and slope drains had been put in place in preparation for the installation of the geosynthetic cap material. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
