PURPOSE OF SITE VISIT: Re-permit (Office review of submittal for permit renewal)
STATUS OF PAST NOTED VIOLATIONS:
No violations noted on the previous inspection conducted on 09/14/15.
OBSERVED VIOLATIONS:
1) Upon review of the submitted records for permit renewal, it was found that the permitted maximum annual
application rate of 50,000 gallons/acre/year had been exceeded for Field 2/2a and Field 4 in 2015. The amount
that was applied in excess to the permitted amount is listed in the “Comments” section below. Exceeding the
maximum annual application rate is a violation of Rule .0838(b)(1) and Permit Condition 7. Rule .0838(b)(1)
states “Maximum land application rates for septage shall be determined based upon the following: (1) Domestic
septage land application rates shall be in accordance with 40 CFR Part 503.12(c)…” Federal Rule 40CFR Part
503.12(c) basically states that domestic septage shall not be applied to agricultural land if the annual application
amount has been reached. Permit Condition 7 states that the maximum annual application rate is 50,000
gal/ac/yr.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1) From the submitted records, the following annual permitted field amounts were exceeded. The permitted field
amount is calculated by multiplying your permitted maximum annual application rate of 50,000 gallons/acre/year
by the acres for each field.

2) The amount of excess will be subtracted from the 2016 permit. You need to make sure that you do not
exceed the maximum annual application rate for a particular field or for the entire site. I will email you an
updated excel spreadsheet that should help you keep up the amount applied to a given field within the year.
3) Currently there are approximately 70.2 acres permitted acres. Of the 70.2 acres, only 46.1 acres (Fields 1,
2, 3, 3a, and 4) are considered active. Based on Rule .0841(a), you should have a minimum storage capacity
equal to the average septage volume pumped per week. The average volume per week for the active fields
comes out to be approximately 44,000 gallons. The storage capacity at your permitted Septage Detention
Facility, permit # SDTF-67-05 is 9,000 gallons. While this site has been permitted this way for a number of
years, by Rule you should have the required storage or an alternative disposal option such as a wastewater
treatment plant authorization for use during periods when the land application site is not available.
4) There are some discrepancies in acres with the GPS maps. Site need to be re-GPS’d.
5) No site visit conducted. Inspection report generated for issues noted from the review of submitted documents for
permit renewal.
