OBSERVED VIOLATIONS: 1) Septage was on the ground in several locations by the tanks. Also, septage had flowed over on one of the 6,500 gallons tanks. See attached pictures. The presence of septage on the ground and on the tank is a violation of Rule .0841 (j) that states “Septage shall be transferred to and from a detention system in a safe and sanitary manner that prevents leaks or spills of septage, including septage in pipes used for transferring waste to and from vehicles.” The spills or overflows of septage onto the ground need to be prevented. Also, any spills that occur need to be cleaned up. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 AREAS OF CONCERN AND COMMENTS: 1) “No Trespassing” sign present as you enter the site. 2) Area around the tanks needs to be mowed. Vegetation starting to grow up around the tanks, especially the 31,500 gallons and 8,000 gallons steel tanks. See attached pictures. 3) Most of the tanks appeared to be structurally sound except for one of the 6,500 gallons steel tanks. The three 6,500 gallons steel tanks are grouped together. The middle 6,500 tank appears to have been patched several times and there is evidence of new leaks as evident by the streaking on both sides of the tank. See attached pictures. Tank may be nearing its’ end as a holding tank. The new leaks need to be patched. Also, the sight glass on the top front end of the tank is missing. A sight glass needs to be placed back in the hole or a plug placed in the hole. There is evidence that septage has flowed out of this hole. 4) There was evidence of several septage spills on the ground by the tanks and on the tanks. See pictures. Any septage on the ground or on the tanks needs to be cleaned up immediately and hydrated lime placed on the spill areas. These spills should not be occurring and must stop. 5) No objectionable odors or vector issues noticed. 6) The three 6,500 gallons steel tanks appear to be used the most. The 31,500 gallons tank did not appeared to have been used recently. 7) The catch basins at the end of the 6,500 gallons tanks need to be pumped out. The basins were very full and the liquid was very black. The basins should be pumped out at the end of every day when septage has been transferred into or out of the tank above the basin. Area needs to be maintained so that the tank can be inspected. Area around the 31,500 gallons tank. Area need to be maintained so that the tank can be inspected. Also, the plumbing to the tank needs repair. The middle 6,500 gallons tank showing its’ age by the signs of patches and evidence of new leaks. The sight glass is missing from the front end of the middle 6,500 gallons tank. Septage has flowed out of the hole sometime in the past.
