During this visit a dark septage spill was noted on the ground in front of the tank. Permit Condition 2. Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules. While on site I called the office number and asked for Mr. Blanks, was told that he was away. Informed the person I was talking to that there was a spill at the tank area which is a violation and that it needed to be cleaned up. Please ensure that the spill area was completely cleaned up and that the waste and contaminated soil was disposed of properly. Review procedures with drivers as needed to prevent any future violations. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The required sign was posted and the access road is adequate. 2. The concrete tank appears structurally sound. 3. No vectors or odors noted. 4. The approved setbacks are being met. 5. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
