NW – Ash, NC 28420 Telephone: 910-755-7670 Email address: ryanhewett@robinsonseptictank.com PARTICIPANTS: Chester Cobb STATUS OF PERMIT: Active EXPIRES: 11/01/15 PURPOSE OF SITE VISIT: Permit Renewal STATUS OF PAST NOTED VIOLATIONS: No violations noted on the previous inspection conducted on 10/19/15. OBSERVED VIOLATIONS: (1) Upon review of the submitted records for permit renewal, it was found that the permitted maximum annual application rate of 50,000 gallons/acre/year had been exceeded for Field 3 in 2012, 2013, and 2014. The amount that was applied in excess to the permitted amount is listed in the “Comments” section below. Exceeding the maximum annual application rate is a violation of Rule .0838(b)(1) and Permit Condition 7. Rule .0838(b)(1) states “Maximum land application rates for septage shall be determined based upon the following: (1) Domestic septage land application rates shall be in accordance with 40 CFR Part 503.12(c)…” Federal Rule 40CFR Part 503.12(c) basically states that domestic septage shall not be applied to agricultural land if the annual application amount has been reached. Permit Condition 7 states that the maximum annual application rate is 50,000 gal/ac/yr. CONTINUE ON NEXT PAGE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 (2) Also from the review of the submitted records, it was found that the monthly application rates were exceeded for several fields between 2012 and 2015. The permitted monthly application rates that were exceeded are listed in the attached table. Exceeding the monthly application rate is a violation of Rule .0838(a)(18) that states “Approved nutrient management plans shall be followed.” The nutrient management plan contains the monthly application rates. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. AREAS OF CONCERN AND COMMENTS: 1) From the submitted records, the maximum annual application rate of 50,000 gal/ac/yr was exceeded for Field 3 during the years listed in the table below. The attached table lists the fields and months as to when the monthly application rates were exceeded. Your nutrient management plan contains the monthly application rates of LOW (5,000 gal/ac), MEDIUM (10,000 gal/ac), and HIGH (15,000 gal/ac). 3) Please closely monitor your applications to the fields so as to not exceed your maximum annual application rate of 50,000 gal/ac/yr on a field basis or your monthly application rates as listed in your nutrient management plan. 4) No site visit conducted.
