Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photos were taken by Lee Hill on February 21, 2017 unless otherwise noted. 2. The closed landfill consists of three waste disposal areas. Two of the areas are located to the southwest of Hinton Center Road and the other is located across Hinton Center Road. 3. All waste disposal areas are secured by gates or chains. 4. Good vegetative cover was observed on all disposal areas and is being maintained on a routine basis. No woody vegetation was observed at the time of inspection. 5. No ponding water was observed on the disposal areas at the time of inspection. 6. One void was observed on the eastern side of the disposal area that is located on the south side of Hinton Center Rd. The void appeared to be approximately one to two feet deep. No waste was observed inside the void. Please fill the void with soil and stabilize the area to prevent any erosion that may occur. 7. All waste disposal areas had edge of waste markers (EOW) installed at the time of inspection. It appeared that one of the EOW markers located at the top of the disposal area closest to the yard waste area had been knocked down and needs to be reinstalled. 8. All groundwater monitoring wells, MW-1 through MW-6 were observed. All wells were locked and the paths to the wells were being maintained. 9. Groundwater monitoring is conducted on an annual basis at the facility and the December 15, 2015 report was available for review. The report for the January 2017 sampling event had not been received at the time of inspection. 10. A landfill gas monitoring plan was submitted to the section on November 22, 2010. The plan is currently under review by the Solid Waste Section-Permitting Branch. Per Post Closure Condition Number 1 of the Closure Letter dated December 21, 1995, the facility must take all measures necessary to ensure that the closed site shall continue to meet the design standards for landfill gas found in 15A NCAC 13B .0503 Siting and Design Requirements for Disposal Sites (2)(a) The concentration of explosive gases generated by the site shall not exceed: (i) twenty-five percent of the limit for the gases in site structures (excluding gas control or recovery system components); and (ii) the lower explosive limit for the gases at the property boundary.
