Dear Mr Darden:
On 28 February 2017, Ray Williams, representing the State of North Carolina, Division of Waste
Management Solid Waste Section (“Section”), inspected the above referenced facility for
compliance with North Carolina Solid Waste Statues and Rules. During this inspection, the
following items were noted and/or observed:
A. 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that
exempted as specified in Rule .0103(c) of this Subchapter shall be responsible for the
sanitary storage of all solid waste accumulated on the property.”
B. 15A NCAC 13B .0104 (b) states “Garbage shall be stored in either durable rust
resistant, non‐absorbent, water‐tight, rodent proof, and easily cleanable
containers with a close fitting fly‐tight cover, when applicable, or other types of
containers acceptable to the local governing agency and conforming to the intent
of this Section.”
C. 15A NCAC 13B .0104 (c) states “Refuse shall be stored in durable containers or as
otherwise provided in this Section. Where garbage is stored in combination with
refuse, containers shall meet the requirements for garbage containers.”
D. 15A NCAC 13B .0104 (f) states “All solid waste shall be stored in such a manner as
to prevent the creation of a nuisance, insanitary conditions, or a potential public
health hazard.”
E. 15A NCAC 13B .0402 (1) states “Operational plans shall be approved and followed
as specified for the facility.”

PART VI: TRANSFER STATION/TREATMENT and PROCESSING UNIT (7)(a) states
“The tipping floor and transfer trailer loading area must be maintained in a clean,
sanitary condition at all times and must be cleaned at least daily in accordance
with the approve Operational Plan.”

PART VI: TRANSFER STATION/TREATMENT and PROCESSING UNIT (7)(e)(ii) states
“Windblown materials must be collected by the end of the day and no windblown
material may be allowed to leave the facility boundary.”
F. 15A NCAC 13B .0402 (7) states “Appropriate method shall be provided to confine
material subject to be blown by the wind within the area. At the conclusion of
each day of operation, all windblown material resulting from the operation shall
be collected and returned to the area by the owner or operator.”
The above deficiencies may have or can compromise the facility’s ability to ensure protection of
the public health and the environment and thus require remedial action on behalf of the facility
in order to achieve compliance with 15A NCAC 13B .0104(a), 15A NCAC 13B .0104 (b), 15A
NCAC 13B .0104 (c), 15A NCAC 13B .0104 (f), 15A NCAC 13B .0402 (1), and 15A NCAC 13B .0402
(7), by 31 April 2017, the facility must complete the following:
1. Collect all windblown materials that have accumulated throughout the Facility and properly
dispose of these wastes.
2. Collect all overflow materials that have accumulated in the trailer loading bay and bay access
areas and properly dispose of these wastes.
3. Collect all overflow materials that have accumulated in the roll‐off/convenience area and
properly dispose of these wastes.
4. Institute proper daily waste overflow and windblown material collection and disposal routines
as required in your approved Permit and Operations Plan.
Failure to comply with this schedule may subject the facility and/or all responsible parties to
enforcement actions including a notice of violation, civil penalty, injunction from operation of a
solid waste management facility or a solid waste collection service and any such further relief as
may be necessary to achieve compliance with the North Carolina Solid Waste Management Act
and Rules. Pursuant to N.C.G.S. 130A‐22(a) and 15A NCAC 13B .0701‐.0707, an administrative
penalty of up to $15,000.00 per day may be assessed for each violation of the Solid Waste Laws,
Regulations, Conditions of a Permit, or an Order issued under Article 9 of Chapter 130A of the
N.C. General Statutes.
